Am I tied into a 12 month contract?
I bought my HD box of ebay and installed it myself..also I installed multiroom myself and asked for another viewing card.
At no time was I told that by paying the extra multi room fee and HD fee I would be locked into a 12 month contract!!
But sky customer services seem to of said that I am>!>?!?!?!?!
So I cant cancel my HD or multi room for 12 months..
Dont you need to sign a contract or at least be told you are to be held into a 12 month contract?
does anyone no my rights?

Perhaps you should refer to the piece of paper that your viewing card was stuck to. Viewing cards sorry.
And if you choose a paperless DD then thats is the signature mystery solved.
Oh and I bet you were told you just can't remember. I have had many installations and dealing with Sky and have always been read out a few mandatory statements. Just the important bits like you have to keep paying us for at least 12 months... have the boxes connected to the telephone line etc.
I bought my HD box from sky and was told that by taking their deal I would have to take the HD package for a minimum of 12 months.
However if i were to ring up and add say, the movie package I could cancel this after a month no problem. surely this is the same with adding HD package to your own kit? Multiroom might be different because as you say you got a new viewing card from them , this might be treated like taking out a whole new contract.
Full (written) details of the HD-contract are enclosed with all HD-STBs and if you phone and ask to take out this contract you are supposed to have read it! It very clearly says 12-months minimum.
ALL boxes come from Sky, if you buy a cheap box off Ebay it's a subsidised box that has come from Sky, and it includes the contract details inside the box.
Regardless where you buy it though, the HD contract is a minimum of 12 months - even if you bought a secondhand (out of warranty) box.
you can cancel the whole subscription and re subscribe without the HD sub assuming you have been a sky subscriber more than 12 months.
It does have that provision. I confirmed that when over the phone and recorded the conversation.
The HD Provision does very much fall in to a 12 month contract, as does any "new" service you may request from Sky (inc Broadband).
The terms and conditions of your contract are printed on the back of the viewing card paperwork.
What was in the box then?
You are supposed to get a plastic wallet containing the STB instruction manual, the Sky-HD contract, the Sky+ contract and the Sky Subscription Contract.
As these are inserted at manufacture it sounds like satbuyer have removed them!
I feel sure that on the QT they bow out cos it does rather try to screw up yr rights
Its bad enough when things are in the small print section but when you dont even get to see it thats really going too far
As it is the EU are at the moment reviewing the whole small print legislation because of the unfair way big companies use it
When you sign up to the Sky Service (as opposed buying the physical box), and receive the viewing card, you are also sent a copy of the Terms and Conditions which form part of a binding legal contract between you and Sky. These terms and conditions set out the 12 month contract period. If you are not willing to enter the 12 month contract you have 14 days (from recieving the card) in which to return it (the law only requires Sky give you 7 days), if you do not back out within the 14 days then the law deems that you have agreed to a binding contract, there is no requirment for you to provide a signature.
In the eyes of the law if you choose not to bother to read a contract document that is your problem, not Sky's and your failure to make yourself aware of the terms that you were provided does not provide you a get out.
Not strictly true - If you sign a contract you have not bothered to read, then its you problem.
For a contract to exist, there must be some demonstrable way to prove all parties included within the bounds of the contracts definitions agree to it.
Usually this would be in the form of a bit of paper with T's&C's and your John Hancock - but in situations like this Sky have a duty to make you aware what you're signing up to, they should explain this all to you over the phone (ie. tell you by having HD youre entering a 12 month contract) - but they also meet their basic requirement by stipulating this in the small print in any literature that relates to HD and contracts.
I bought a box off ebay - phoned up Sky to get the HD sub, and they told me this meant I was agreeing to a 12 month subscription term. There was nothing in the HD box packaging other than intructions.
If they didnt tell me on the phone AND there was no literature in the box, or sent out to me about HD, and I could demonstrate that I could have conceivably been unaware that a 12 mnth sub was required - then maybe I would have a case.
I'm sure Sky are aware that they have in all but a very small minority of cases met their minimum requirement - but if you sound knowledgeable enough, and get the right person and argue well enough they may decide its not worth the hassle/expense to deal with you and cancel you.
In which case the person you bought it off probably removed it, all the ones I've seen include the contract details.
My experience is that as well as the docs that should be in the box, Sky also send out another copy of T&C's within the cooling off period. I would agree that if they failed to do so that there would be no agreement (Also that failing to notify the consumer of the statutory 7 day coolling off [a]after the call is made[/b] breaches their consumer credit licence). I would be very surprised if they did not, as they know well fine that this could leave them in this type of situation.
However if Sky claim they did then there is no 12 month contract. Of course getting sky to admint that and not place a serious back mark on a consumers cretid rating would be fairly difficult, without the consumer going to court up against some fairly well paid corporate lawyers.
Seems to depend on who you speak to at sky on HD contracts.
Some are being told and actually are cancelling before 12months if you provide your own box.
When I called sky to enquire about cancelling HD I was told it was 12 months no matter where the box came from:eek:
As far as I can remember when we took out 3rd multiroom box which we provided,terms were something along the lines of unless you cancel whole account/package with sky,multi room subscription must remain in place for 12 months.
As the multiroom deal is a discounted deal you will be subject to that for 12 months.
But not on the HD payment.
Thats not discounted - its simply a monthly fee like Sky+ or movies or sport and providing you received no Sky subsidy you can switch it off and on a month at a time.
I bought an HD box off ebay and have the HD package for 1 month only
But that only refers to buying it off Sky where a price subsidy would have been given as part of the deal.
Buy the box yourself and you dont need to pay it.
You'll have to let Sky know about that then because I bought my box off ebay and subscribed to HD for just one month
I have yet to speak to any CS agent who has tried to say the sub is 12 months when you change the box yourself
Edit: Because there are so many people incorrectly believing the 12 month nonsense I called up Sky again tonight and once again they confimed that my HD sub will end on the 21st feb , one month to the day that it started.
If you buy the box from Sky they give you a subsidy of between £100 and £200 on the HD box PROVIDING you take the HD sub for 12 months.
Ebay buyers like me do not receive that subsidy so it does not apply to us.
The paperwork within the HD box assumes that the box is bought from Sky.
As with cards and subscriptions , nothing is transferable when the box is resold.
Everyone knows that.
We are discussing the sub when the HD box is not bought from Sky.
And as I have already explained you only have to stick to the HD sub for 12 months if your box is bought from Sky or one of their appointed agents/retailers
Even if they were included in the box it doesnt automatically mean you are bound by them.
You can buy an HD box and unless you subscribe to movies or sport there's no need to even contact Sky to pair the card.
Edit- hopefully we are all clear that this refers simply to switching an existing Sky box over to the HD box and that the buyer has already been a Sky customer for over a year.
If you buy the box from scratch and are not currently a subscriber then any subs will be for the 12 months.
The box came from Sky, you bought it from a Sky ASA (authorised dealer), and you probably received an even larger subsidy than you would direct from Sky.
It's not like you bought a full price non-subsidised box.
I didnt buy it from a Sky agent.
I bought it brand new off a guy who was moving house and then decided to use the cable service in his new house instead of using the HD box.
What he paid for it I dont know.
But why dont you just admit you were wrong.
I've already cancelled my HD sub and have clarified with more than one CS agent that its only 12 months when receiving a Sky subsidy on the box.
I know you work for a retailer so I assume you only know the T&C's that apply when you supply the box.
But check the Sky website.
The HD prices are there and it clearly states that the box is £399 unless you take the HD sub
Exactly, if you didn't pay £399 then it's a subsidised box, you seem to already understand that.
If you paid Sky (or their agent), but paid less than £399, then you are being subsidised. If you bought it from a third party (non-Sky agent), no matter what you paid, Sky are not subsidising your purchase of that box.
