will virgin allow this
Hi all, my relationship has just broken up and now im sort of stuck in a problem.
Our virgin service was in my ex's name and hes buggered off to London, I currently have BB phone Tivo and V+ and we were currently paying £50 a month by DD. I know the password to the account and have tried to speak to Virgins CS, however either she couldnt understand me, or refused to acknowledge what i was asking. We were currently five months into a 12 month contract. I tried to get them to turn it either off or down to the most minimum package.. But the CS wouldnt budge. The question is what can i do? He couldnt transfer the services to where he is at the moment as he is living in a non virgin cabled area. Any info would be greatly appreciated. |

My guess is you won't be able to cancel the contract without paying the penalty, no matter what you tell them. I think after the promotional period (6 months half price), you can downgrade the services if you want, but not before.

Is the account under his name, is the charge under his name. If yes give CAB a call see if they can assist.

Yes the account is in his name, however i only know the area which he now resides. I do not have an address... Virgin know his new address as he has virgin mobile, so i dont understand why they say the have no record of a change of address... Dont mobile and media communicate? Ive been told by the CAB to disconnect all the boxes and not use them, and if possible give them to him for collection by virgin media.
However Virgin CS have told me im NOT ALLOWED to remove the boxes from my property without asking consent from them first. So i asked, only to be told i cannot as the account is in dispute... ???

Yup, I hope the DD is from his bank account and not yours or a joint. If it is a joint, get to the bank and put a halt on it.
Failing that, fire off an email to the CEO's office explaining your situation... neil.berkett@virginmedia.co.uk ...they are far more capable of helping with your dilemma. |

write to virgin, informing them of the change, and that the contract holder no longer live here, and ask them to pick up there equipment
Point out, direct debit will be cancelled, and any payment they request should eb sent to the contract holder, if they know his address |

If payments are coming from his account and service in his name, then either let him carry on paying or if you want cancel the DD that's for you to decide about accessing his bank account.
You do have to keep hold of the equipment and give VM the chance of collecting etc |

Give Home Movers a call. Explain the situation and give them as much info as you can about where he is now and they will apply charges which he is liable. If you want to keep the services as if you can do a Transfer of Responsibility

sorry about delay, yes the payments are coming out of his account, ive told him about not wanting them, (mainly because he reads the phone bill and goes ballistic if i make calls out of the free call times) Virgin again have stated they wont tell me anything, because the account is not in my name, yet he is refusing to contacct virgin. so im going to let him pay for it. I will know when he stops as the service will be shut off.

As the contract is in your partners name and the Direct Debit is paid from his account then you don't need to worry. If he wants to cancel then it is his responsibly as the account holder to do so. You have zero liability so don't worry about it. Just remember not to run up any additional bill such as phone or PPV.
You should just leave it all set up and continue to use the BB and TV but unplug the phone line and not use it if he is complaining about the phone bill. |

I am not sure from what you have said so far whether this split is acrimonious or not. If it is, you could run up a hefty Virgin bill by using the phone at will, he is liable but in theory hecould try and get the money back off you at a later stage. He could take you to court for the money if you had digregarded his instructions on permitted usage.
But as far as the contract with Virgin goes - your initial query - I don't see why you are worried if he is still paying the DD. If he stops paying, Virgin will take action against him, not you. You may have been better off not telling them in the first place that he had gone. Anyway, he might be back next week with a bunch of flowers...... |
