Hi
can anyone help me work out how much holiday entitlement I should have accrued since jan 1st 2013, annual holiday allowance 20 days, and how much this equates to before tax for a 17k salary 37.5 hours a week.
Thanks

Near as 7/52 weeks x 20 days = 2.7 days, approx £176 pay in lieu.

It should work out at 1.66 days per month, so about 3 days holiday.

I also assume the 20 days doesn't include bank holidays, because you should get 28 days in total.

Not sure about tax though.

Are you full time? Surely the WTD set full time minimum to 20 days + 8 bank holidays (or less, pro-rata, for part-time workers - but always 5.6 x <number of days worked in your normal working week>)

More here;

5 days a week? Big company or small family concern? Either way, the rules are clear - 5.6 x number of days in your normal working week, is the minimum you should be entitled to. My previous link explains it clearly. Print it out and give it your employer!

When you leave they owe you any unpaid holiday, calculated pro rata from your full entitlement of 28 days. So it's definitely worth bringing it up!

My company hasn't paid my entitlement in my last wage. Am I right in thinking that holiday is still accrued whilst receiving SSP ?

According to the government's website:

Statutory holiday entitlement is built up (accrued) while an employee is off work sick (no matter how long theyíre off).

Any statutory holiday entitlement that isnít used because of illness can be carried over into the next leave year.

Employees can choose to take holiday instead of sick leave. For example, because they donít qualify for sick pay. Also, if an employee is ill just before or during their leave, they can take it as sick leave and take the missed leave at a later date.

I get 25 days now (been here so long now and you get an extra 4 days after 5 years) plus the 8 banks holidays plus 6 closure days. My partner gets 28 days but then he has to work bank holidays.

I may have missed something here, but I'm reading that as you were expecting payment in lieu? Why were you expecting to get paid for your entitlement as opposed to accruing the days or was it some leave you took that they didn't pay you for?

In the US I believe they only get 2 weeks paid holiday and Japan or China just 1 week.

In the US they often get NO paid time off until they have been with the company a year or two years, and then it's something crazy like a week.
