Surely it only counts as working if they are being paid - otherwise they are just helping out, which I'd imagine is a different thing entirely.
No, not at all. The law even gives an example of a child helping out in their parents shop and states that is illegal. It is illegal for any child under 13 to do any sort of work, paid or unpaid for anyone unless they have a performance license.
What is meant by employment?
As well as employment in its normal meaning,
the Children and Young Persons Act 1933 states
that a person who assists in a trade or occupation
carried on for profit is considered as employed
even though he or she may receive no payment.
So the rules in the Children and Young Persons Act
will apply where, for example, children help their
parents in a shop without receiving any payment.
The actual words used in the Act here are a “person

profit”. In today’s circumstances DCSF considers
that any occupation where the aim is to make
a surplus would be considered as a trade or
occupation carried on for profit s

I thought it was, also the younger child ( what was he, 8 or 9?) works in the hotel, on trip advisor there is one comment that said they were served by the younger child at reception, how are they getting away with this?
They're getting away with it because no-one has made a complaint to the police about it...Given the publicity perhaps someone now will.

Did anyone else think that one of the owners sounded very much like Hilary Devey? It was uncanny.
Thank you, it's been driving me nuts trying to figure out who she sounded like:).
Yes, totally agree.
