I should add that this all come up because 2 or 3 members are trialling TP link 3G modem / routers with a view to putting a One Plan sim in and getting more than the maximum mobile broadband data package provides. The question came up as to whether Three could detect the device, and as I pointed out, it isn't the device they do the detection on it's the type of traffic that gives you away, such as User Agent browser headers. Whist these can be spoofed, that would lead to mobile pages loading by default and difficulties with some videos etc.

A VPN is one way of getting around this agreed, but again free VPNs that have decent speeds are not easy to find and come with some negatives. If you did use a VPN you may get around restrictions, but it is possible for Three to put One Plan users using a VPN into the tethering pool by default if they start seeing a large number of One plan users using VPNs and large amounts of data.

You should still get reasonable speeds from 3PM - midnight whilst tethering, something like 1-2 megs but it'll depend on tethering usage by other users at that point in time.

This is Three's current published stance on caps and throttling. It sounds like you may be right Jabbank1, but it is subject to change at any time.

There are 2 sections to the document below, first data limit caps where they confirm there is no data cap on The One plan, but are on other tariffs.

Section 2 is about throttling, here is what they say in section 2:

Is traffic management used during peak hours? Yes
    When are typical peak hours? Weekdays:15:00 – 00.00 Weekends: 15:00 – 00.00

What type of traffic is managed during these periods?***
Traffic type Blocked Slowed down Prioritised
    Peer to Peer (P2P) π

Is traffic management used to manage congestion in particular locations? All sites

If so how? We allocate a fixed amount of network bandwidth to P2P file-sharing activities and to tethering activities at peak times to manage network congestion and provide the best possible experience for the greatest number of users.

We use video optimisation to change the way video content is streamed to your device to make it play better. We use it to improve your streaming experience if our network is busy where you are.

We’re currently trialling different ways of using TrafficSense™ to get the best out of our network for the greatest number of users. This includes evaluating techniques that would affect a small proportion of the heaviest users at peak times. Before we implement anything new we’ll clearly explain to you how it works, and we’ll let you know if you are likely to be affected. Our approaches may vary over time in order to meet network demand.

Ah! That's the proof then. Thanks for that. I remember being told by the guys at Three that this was no longer the case. I've also been told the new trafficsense tool and changes for 4G and tethering has been pushed back as well.

Here is further proof that it was 5% last year but that's now gone.
