Bradford and Bingley thwarted in repossession again

Bailiffs attempting to evict a cancer patient from his home have been blocked by a crowd of hundreds of people - for the second time in the past six months.

The 300-strong group of protesters converged on a quiet street in Nottingham this morning to stop frail Tom Crawford, 63, from being evicted from the bungalow he has called home for the past 25 years.

Grandfather-of-two Mr Crawford has been embroiled in a five-year legal battle with Bradford & Bingley bank over his mortgage.

The bank says he still owes £43,000 but he insists he doesn't owe a penny.

Mr Crawford was diagnosed with prostate cancer in 2011.

And heres the legal mumbo jumbo the B&B used to justify their actions,

In a statement, UKAR, which manages mortgage lenders of Bradford & Bingley, said: "Repossession is always viewed as a last resort and follows a series of forbearance options, with the aim of finding a solution that takes account of the customer's specific circumstances.

"Regrettably, in this instance, we have been unable to find a solution.

"Bradford & Bingley has followed proper legal procedures and is now legally entitled to take possession of this property following the ruling by the Court and the Judge.

"We have a valid possession order that is enforceable."

Bailiffs were previously stopped from evicting him by a crowd of more than 200 Facebook users in July 2014.

    Before passing judgement on the big bad bank, you need to understand that this Tom bloke is someone who calls himself a 'freeman of the land'.

    I dont understand the full ins and outs of what they believe but basically they do not believe that debts have to be paid, that contracts have to be honored and that laws are lawfully passed and therefore they dont believe in them.

    Hence, I doubt very much he has paid his mortgage as described and the fact that he is unfortunately ill, is irrelevant.

    I'm not sure that having cancer absolves you of any outstanding mortgage, so not really sure what you expect a lender to do.

    More interesting is one of the comments to the story, that if correct, makes things a lot clearer.
    According to Tom Crawford's YouTube video. He took out an endowment mortgage is 1988 and around 2000 was told that the endowment policy would not cover the original loan amount. He doesn't seem to have done anything about this and when Bradford & Bingley seemingly unilaterally changed the loan to a repayment type so that at least some of the capital would be covered, he insisted they change it back to an endowment. There was further confusion and it appears that he was only paying interest from about 2000. Although he discovered this around 2005 he did nothing about covering the original loan. By the end of the loan period in 2013 he had discovered the Get Out Of Debt Free website and attempted to avoid being chased for the outstanding amount by launching proceeding against B&B on the grounds that money is simply created out of thin air and thus B&B hadn't actually loaned him anything. He thus feels that what he has paid to date is "enough". Unsurprisingly, the court disagreed and since he is refusing to pay the outstanding sum his house is being repossessed. The GOODF website is replete with these (and many less savoury) theories many of which involve avoiding obligations to pay for goods and services.

    This is the YouTube video that contains that information. There are others and the story and dates tend to change somewhat.

    The chap with the ponytail is Mark "Ceylon" Haining and this video is posted on his YouTube channel. "Ceylon" is leading light of the Get Out Of Debt Free website which instructs fellow "lawful rebellion" disciples how to avoid paying for utilities, council tax and to frustrate bailiffs attempts to obtain payment. It also is a vehicle for a variety of conspiracy theories including some unpleasant ideas about the murder of Lee Rigby and the ISIS hostages as well as some casual anti-semitism.

    Unfortunately Tom Crawford is a willing and enthusiastic exponent of at least some of these ideas. I believe he could still negotiate a way of staying in his house but that he is too embroiled in this GOODF nonsense to take a sensible decision.

    And I don't suppose he has twigged yet that all these delaying tactics and associated costs will come out of any surplus that is due to him when the property is eventually re-possessed and sold.
