    Morgsie, I feel so bad for you. I am so sorry you are having to go through all of this. It is not your fault though, this landlord is trying to take advantage of you.

    Your landlord is in the wrong though but I understand how frightening and scary this must be for you. Its more pressure than you need. I wish I could help :(

    Your landlord needs to give you 2 months notice with a section 21 and even then you don't have to go. If you stay in the property beyond the date on the section 21 , the landlord has to start court proceedings which will take weeks so try not to worry as he can't legally kick you out for weeks even if the current section 21 is valid.

    However, It sounds like the section 21 is not valid anyway and so the landlord may have to issue another and wait another 2 clear months before staring any court procedure.

    You have been to housing and that is good but you also need to talk to the Tenancy Relations Officer at the council (prob different team) as he/she can talk to the landlord and advise them that harassment is a criminal offence and that they need to follow the correct procedure.

    As for the CAB, some offices don't like their volunteers to also be clients so perhaps try their telephone advice line (which can go to a random office) or shelter as others have said. If you are not working or on a low income, you can get Legal Aid as you have been served a section 21 so give Community Legal Advice line a call on 0345 345 4 345 and they can represent you.

    Legally you have at least 2 months before you need to get out so you do have time to get help with other options.

    He's an idiot then, for agreeing a new tenancy before the old one has ended. Or else he's trying to guilt trip you into leaving. Either way, its important that you don't give in.

    If you leave before you have to, the council could (I stress it's only could, they'd be a bit mean to do it) say that you've made yourself homeless intentionally and that could mean they don't have a duty to help you. Its important that you stay put until a valid S21 notice has been properly issued and has run its course.

    if he put a date on the notice that is before the date it was actually issued, I doubt if that notice would become valid even 2 months after it was issued; he may well have to start the process all over again with a new notice with a new date on it.

    If you're anywhere near Sussex, I could write to him on headed paper from the advice agency I work for, pointing out that his notice is not enforceable, but that would look a bit suspect if you're up north!

    I'll repeat it again - get some specialist advice, the council will be able to tell you who to contact for this.

    I hppe you get it sorted and have someone to support you now Morgsie, it seems too much for anyone to bear, and will be an absolute nightmare for yourself with autism I can only imagine.

    Your landlord is, truly is a rotten individual to put it politely..Hope the council at least mark his card...

    As the landlord is trying to commit a crime it may be worth having a chat with the police to see if they can have a word.

    landlord keeps coming round unannounced, today I was asleep when he came round late morning. Asking for updates and is inquiring about places.

    Met my support work from the Access Team today and explained the situation and he is meeting me on Friday morning and looking at other agencies for support.

    I think I have been offered a flat which I bid on and gave Housing ESA letters and bank statements. Need to go to another office tomorrow.

    Interview with CAB is next week, I have applied to be an adviser

    Wow, fingers crossed about the flat and I hope the interview goes well, too.

    There should be an equivalent to Trip Advisor for landlords. At least prospective tenants could find out if the landlord was unreasonable before they moved in, instead of afterwards.

    Sorry for bumping this but Landlord came round gave notification of where the deposit is and new section 21. Still wants me out ASAP and said I would not like it if it was the other way round, me moving in.

    Took a photo and made me sign something to say I received both documents

    He's a cheeky beggar, isn't he? Trying to make out it's your responsibility for him letting your flat out before it was vacant? I seriously don't envy anyone who has that git for a landlord. Cheeky sod, he is.

    What do the dates on the new documents say? The day he took the photo, or did he pre-date them again?

    He knows he is in the wrong, and has had to start again take the new notice to the council so they can take a copy and for them to check its all in order, hope you get sorted

    This is making me very anxious and panicky etc

    This makes me sick treating ppl like this, just who do these landlords think they are? Shame on them!

    Do you have any close family or friends to help you with this? Please get the right advise & do not lie to cover this landlords backside!

    Do you have a social worker? if so contact them straight away & get them to help!

    I really hope this is sorted out for you really soon & you feel more secure in your home..Sorry I couldn't be much help, Take Care!
