The law is an ass, we know that.

Take the sentencing out of the judges hands and bring in sentencing by the nation. When it comes to sentencing someone found guilty the public should vote as to the appropriate punishment through all the available technology we have today. That way we get a fair result.

    Reflects society unfortunately.

People will come here telling you that you can't compare crimes, but the truth is reflected in threads like the ones about free school dinners. As a society we are completely fragmented, not caring or feeling responsible for anyone but our own.

There'll be the usual wealth of background information not present that people will say means we can't fairly judge this but yeah...it's a pretty fecked up state of affairs when the offensiveness of bacon outranks the horror of child porn when it comes to punishment tbh.

I assume the bacon crime was classed as a hate crime. That cranks up the sentence.
Now if you could make paedophilia a hate crime you would see some real sentences passed down.

10 months custodial sentence for offending people? On which plane of reality is that right?

What we need are younger judges. Many judges today are just too old. Some of them come from a world where sexual harrassment, assault, rape etc...was just considered "a bit of fun" or "boys just being boys" and other fossilised arguments. Many of them are also disconnected from the real world. It's why chavs get away with warnings and cautions even when their behaviour is akin to something from "A Clockwork Orange"

It's not merely offending people. It's certainly a hate crime. Similar to the KKK burning a cross in front of a black person's house. The sentence was correct.

Unless he had a list of previous as long as your arm that guaranteed any subsequent crime would see this type of sentence, then it was in no way correct.

I have to disagree with you, it's a lot of money to be wasting sending someone to prison for putting bacon on a door handle, Infact it's absurd.

Give him a fine or whatever but a prison sentence for bacon on a door handle is just ridiculous

If the judge was the same in both cases, you would have a point, OP. If not, then it's simply one judge not passing an appropriate sentence in the child porn case. The other sentence was fine.

I don't care what he's done before. This act alone warrants the sentence.

If he had put bacon on just any door handle, I would agree. The fact it was done to a mosque is a clear sign of a hate crime. That's what makes it more serious.

    This I do agree with.

But prison is overcrowded enough in this country, people are getting sent there for very minor offences, I think it's an outrageously over the top sentence, an unnecessary sentence by a country mile.

Give him a slap on the wrists like a caution and a fine but 10 months in prison? No chance

Unless of course he's a repeat offender and has been nothing but a problem in his community and was on his last warning

    Are they overcrowded in Scotland?

The intent was almost certainly to rub up at least some (most probably wouldn't have batted an eyelid) of the people who attend the mosque by leaving something there that their abstract beliefs say they should avoid or be averse to. I doubt a photo of two gay people kissing, something Catholics may be averse to, pinned to the door of the local Catholic Church would be considered a "hate crime" or indeed, any crime at all. Merely somebody being a bit of a nuisance. To convict somebody of this "offence" and then imprison them for it, seems way OTT.

I believe so yes, last year Scotland reached record overcrowding in prisons which inevitably was straining their system, by all accounts this is still the case.

I can understand that the mosque attack is a hate crime and yes it should be dealt with but Im disgusted at the fact that this monster has been caught with 15,000 images and 275 videos of children and is let off with being placed on a community order with 300 hours of unpaid work and to keep a "readable computer history" !!! I wonder if this has anything to do with the fact that he was an ex-depute procurator fiscal???
