Made at least 50 years ago, (may have been re-done I don't know)
Two guys talking about the death penalty (I think) one argues how easy it would be for an innocent man to be convicted of a capital crime, so he sets out to prove it, his safety net being that his friend knows the truth and will step in at the last minute to save him from execution.
Slight flaw in plan however, man is convicted and sentenced to die but his friend is killed and cannot come forward to save him.
That's the gist of it anyway.
Any ideas?

Do you think it is a Hitchcock film perhaps ?
Sounds a bit like Strangers on a train
Edit:
http://www.imdb.com/title/tt0038722/
OP it's probably one of those but another that you might like to view is
The Life of David Gale
http://www.imdb.com/title/tt0289992/
It couldn't sound any less like Strangers on a Train
I think you got it Takae:)
They probably meant Rope? The idea of whether it's possible to get away with murder.
Yay.
More annoying i can't name the remake
I have a feeling it may have been used in a tv episode or two as well, it's a familiar plot device.
I could see Dana Andrews behind bars in my mind, so I looked up his films on IMDB
That could also have been the one I remember zebedee, I can't be sure because it is the story I remember rather than who was in it:)
