It will be pointed down at the door way although you do raise a good point.. would be an interesting plot twist with the Derek vs Phil story line.

Also, Rose's comment about them spending the afternoon together an off-the-record comment, not given in a formal statement therefore couldn't be used against him/Rose. Hating the usual panto attitude of the detective.
