DS Lite top screen has stopped working - advice needed

My girlfriend bought her little brother a DS Lite console for Christmas and now the top screen doesn't work, although it worked fine at first.
She bought it from a Chinese seller on ebay who is not replying to her emails about it. (I am under the impression that the warranty is between Nintendo and the final purchaser so the ebay seller has nothing to do with it but I could be wrong.) Her little brother tore it open on Xmas day and threw all the packaging away, so didn't send anything off.
Anyway. Does anyone have an idea if this is a common problem/ advice on how to fix it/ links to look at etc? Any help/comments would be greatly appreciated!
