Can my employer sack me with me having a sick note?

Hi chaps, I'll keep this as brief as possible. Ive been off sick for 14 days, I have a Doctors Certificate to cover all of this period.
Ive only just started at my new job (not good i know) but Ive been off with Anxiety & Depression, kinda went AWOL for a bit too at work, but as said above all of my sickness is covered by the note...Can my employer get rid of me?
Ive got a disciplinary hearing tomorrow to discuss why i haven't followed the company's sick procedure i.e. not handing in a note (yet).
Im still in my prob period aswell.
Any help would be much appreciated.

What makes you say that? Legally they must be on dodgy ground?
Some would not recognise anxiety and depression as a valid excuse and think you were just "pulling the wag" or in need of counselling.
If they did sack you,you can get substantial damage award payments as it could be argued that your place of work did not manage your anxiety/depression properly and that your place of work has a duty to assist you.
I phoned in the first day of absence to say I wasn;t coming in. But did not mention the "cause" as i didnt know how to approach the issue of depression/anxiety with my new employer.
Ive been at rock bottom recently and my employer did call a couple of times over the period, and we agreed that i would come in (back to work) but i didnt as wasnt up to it.
I may have pissed them around a bit but im not very well and do have a sick note to cover this. It looks shit I know but just wanna know if its gunna be a done deal tomorrow?
Im happy to resign if they want me too as havn't been there long and may have another job offer.
Just dont see the point or the legality of them sacking me is?
If you are in prob period, they can do what they want.
also why the hell did you agree with your boss to go in and then not go? Why agree to something you knew you weren't up for.
Also how long had you been with them before you started going off?
Do they know you suffer from anxiety and depression now? Have you explained the situation to them or just given them a sick note and left it at that?
3 weeks prior to this.
And I basically gave up on everything, didnt want to speak to anyone and yes, I did speak to my doc 5 days into the absence and he said he would be happy to issue a sick note but he said i should try and get back to work. Which I kinda agreed.
So phoned up my line manager after the docs and said i would be in, and didnt turn up as I was having doubts and was an still are depressed.
I look a **** i know, but i really dont want to be like this but this is what depression does to you.
Do you think i should resign and save face?
You might want to think about jumping before you are pushed as it'll look better on your CV.
In the pre employment medical i stated i suffered from stress which i did back in August.
They dont know I am suffering from depression as Im gunna hand in the sick note tomorrow at the hearing ( i know its late).
But prior to working at my new job I have never been diagnosed or took medication for depression.
Nor am i now. But this may be something I'll have to re-visit.
you cant really expect them to be considerate for your illness if you havent told them or followed company procedure
its then down the the employee to take it up and fight it...

Then i need to resign before any hearing tomorrow then, cos if I turn up they could sack me. Although only been there since Jan 5th so I wouldn't even put it on the CV...

I go there and state my case, and if they want rid of me I'll resign, is that pluasible?
"I may have pissed them around a bit" doesn't really cover it. From their point of view, you were due to come into work on a particular day & rang saying you weren't coming in but didn't give the reason why. You then stayed off work, but haven't provided a certificate. Even when you agreed to return to work, you didn't do so, which at some level must have caused them inconvenience, & your employer still doesn't know why you've been off.
At the very least, I think you can expect a warning, but don't be surprised if they sack you. You've only been there for a few weeks, & have been off work for a good portion of that, so they might well say that you're medically unfit to do the job. In your shoes, especially if you think there's the chance of another job to go to, I'd resign rather than have a sacking on my record.
Jump if you can, but it might be too late
Be honest now, do you even want this job? Sounds to me like you've already found something else.
If you've never been diagnosed with depression what makes you say you have it?
I have a resignation letter written out now, do you think I should run round the Post Office and get it sent of Special Delivery 9AM?
Like i say depression is a horrible thing and maybe i should have been more open with my employer butreally didnt know what to say to my line manager when he asked "are you able to tell me whats wrong?"
He's a great guy but I think imight have tested his patience on this one.

Personally, I think you already knew the answer before your posted your question.
I've been off since 20th January when I had an operation. I'm hoping to get back to work on 23rd Feb (doc signed me off until 20th Feb and yes, I posted the certificate first class that same day even though work were very aware of the situation). All through my absence I've kept in touch with my line manager and she's been great. Most bosses are understanding but you've not been very fair to yours have you?
I haven't found anything else for definate but i dont feel fussed either way over this? Is that wierd?
