    Don't care if it was 15 seconds - a woman screaming just once proves that your hero is a murdering bastard.

    But you think it was him screaming as he "carefully" walked up a corridor to confront an intruder, too scared to put the lights on.

    Thank you for the offer of an invisible cloak. How about a swap with my Common Sense For Dummies book? I have never needed it myself but I am sure you could use it ;-)

    Dolus Directus (direct intent), is where the accused meant to perpetrate the prohibited conduct, or to bring about the criminal consequence and where the consequences of an action were both foreseen and desired by the perpetrator. You want to kill someone, so you shoot him. In this case the perpetrator had a specific victim in mind and then went about killing him or her.

    Dolus eventualis (without intent) exists where the accused does not mean to actually cause the unlawful consequence which follows from his conduct, but foresees or should foresee the possibility of the consequences ensuing, and nonetheless proceeds with his conduct. An example would be of an assault where a perpetrator gets into a fight and uses a knuckle duster to beat up the victim, not actually intending to kill the victim, and the victim dies.

    Culpable homicide has been defined simply as the unlawful negligent killing of a human being. The essential difference with this crime from those mentioned above lies in the fact that the fault in this crime stems from negligence (culpa) and not intent. The test in determining whether the accused is guilty of this crime lies in the question – “what a reasonable person would have done given the same circumstances?

    Love it: the old guard of this thread is once more honing in on the crux of the matter: evidence of screams ending with sounds. What's your take on OP's screaming according to his version as laid out in the piece by Donmack? ( http://www.biznews.com/oscar-pistori...ts-us-believe/ )

    just while we're touching on the subject of the screams... i watched a video recently on youtube (sandy posted it in the trench) of a dog dressed as a spider going round scaring people (i promise this will be on topic :p) and two girls screamed in fright... there is no way i can really see oscar even managed to scream like that. and that was just fright. that wasn't in fear of their lives. it's very, very, very unlikely that a bloke can scream like that. i just do not see it happening. it was also an automatic reaction from them. they didn't think about what exactly it was they were seeing, so i don't believe reeva didn't scram after getting hit by the first shot. there's no way she stayed quiet the whole time

    Clearly showing the strain of his ordeal, a bearded and stressed Pistorius admitted that he was not coping with the pressure.

    It also emerged this week that the disabled athlete has ditched all of the homes he owned in South Africa, which suggests he is bracing for a lengthy legal battle if convicted on Thursday when Judge Thokozile Masipa hands down judgment.

    Pistorius exploded with anger when he pulled up to the Waterkloof house in a new white Volvo XC60 on Friday and saw a Sunday Times team.


    He's bloomin lucky he's even out on bail, he can't have it all ways - of course media are there and probably a nuisance for him --, but he's not in a prison cell like most on Trial for Murder.

    Obviously the trench is some sort of parallel universe where dogs look like spiders and women scream like Oscar Pistorius. Best avoided at my age. :)

    Siobhan has a good point, because in that VT , a girl is screaming , genuinely in fear - so that was the relevance, and it was easy to just pop the VT of that on here, to have a listen if interested. And anyone's welcome in the Trench ! :D;-)

    The girls screaming made me shudder inside, especially thinking how Reeva must've screamed. So much that it haunts the witnesses and will for the rest of their lives :(

    It is definitely just a rumour that Roux tried to plea bargain with Nel and Nel refused.

    I did say it wasn't verified....and I doubt it ever will be, even if true.
