Firstly if it was not legit MS would have little power to stop the auction, this listing simply said it was Xbox durango with intel cpu a wired controller and dedicated graphics card. The only thing they could go for is violation of Xbox trademark, somthing they've obviously not done.

It simply pointless doing anything if it was not legit, makes people think it was real, gives the guy what he wants attention. The example is far more damaging as in most case your example would be criminal offence.

However it was legit it could compromise a lot of things, especially lot of information about the SDK of new Xbox. So yes think If this taken down it would strength the fact of being real, do I think would confirm it no I don't.
