He is, surely. He's had experience of working in shows and on TV productions but he is a schoolboy at the local comprehensive school with a hobby he does one morning a week - he probably gets paid for his work but it's probably freelance at best and he presumably doesn't have a regular income from it, nor does he get that much (money or work) compared to an adult doing the same thing (who would be). He has professional experience but it isn't his job, his occupation is a school kid (and presumably he has to pay for stage school, his singing lessons etc as well). He knows more about his working status etc than people on a forum.
Also, since BGT is open to amateurs and professionals of any age does it really matter? He's an extremely talented boy of 12, like him or not.
