Are "Tulip Mobile" a dodgy company?

Hi,

I was telephoned recently by "Tulip mobile" and sold a 3 video phone over the telephone - everything was fine except that they lied about the inclusive minutes in the monthly line rental.

When I found out what they had done I phoned them up to cancel my contract, they told me this was not possible and told me, "nevermind, just keep enjoying using the phone"! I phoned to cancel less than 7 days after receiving the phone, but they insisted they could not take it back. When I mentioned they had lied and threatened to complain to trading standards they promised to replay the tape of the original sales call and get back to me... of course they never did. I rang five times in total, and was told the same thing five times... they would investiagte and get back to me. They never did. I am 99% sure it is run from an Indian call centre who do not give a toss.

Well, I sent the phone back to them and told 3 that the phone had been cancelled but 3 tell me the only way they can cancel the contract is if Tulip Mobile tell them the contract is cancelled, until then they will keep billing me!

Today I was told by Trading Standards that I should put everything in writing to 3, but told me that because I did not actually sign a contract, but bought the phone over the telephone, that I was NOT legally bound by a contract and did not have to pay 3. (They said if I had signed a contract I would have to keep paying 3 until the matter was sorted out).

Does this sound right? I personally thought verbal agreements were as legally binding as signed paper contracts.

Does anyone here know the correct legal position on this?

P.S. The written documentation that Tulip supplied backed up what they said on the phone about the inclusive minutes - but this is *NOT* what 3's price plan charges me!

sounds about right, you are protected by the time and distance selling regulations that apply to anything sold to you at distance- just do a search on yahoo etc......

No matter what "Tulip Mobile" say, you are legally entitled to return the phone up to 14 days after purchase without any penalties. I believe this applies to any contract phone purchase in the UK.

Since you mention that you have written documentation from Tulip with their version of the inclusive minutes, as you were sold on the phone, this strengthens your case. It sounds like you were mis sold the package, and you should in law only be bound by what you were sold. If 3 don't live up to the agreement you were sold by their agents (ie Tulip), then 3 are at fault. Contact OFCOM and see what they have to say about the matter. If they can't help, they may be able to pass you onto the top office at 3, who should get it sorted.

i was on the internet an searched for mobile phone on google and a searchscout window popped up. i was about to close it when i saw this at the tope of it's list http://www.tulipplus.com/ . i thought that it might be connected in some way, so yeah.

Do you have an address and telephone number for Tulip Mobile?
If so, please post the details.
Are they the same company mentioned by tjclague (elsewhere in this thread)?
