Datamind.......have you dealt with this mob?
I made an online purchase for an MP3 player from Datamind and received an acknowledgement of my order. The total price was £255 (I had telephoned them to get a confirmed total price before I made the online order). 7 days later they contacted me and wanted another £20 "because the price has gone up" and since I refused to have £20 extorted from me they cancelled my order. Has anyone else had the misfortune to deal with this lot. Not sure how this stands legally but I thought I'd share my experience with you incase anyone else is thinking of buying from them.
Personally I won't be near them again and I'll certainly do my best to confince anyone thinking of buying from them to change their mind... |

They were actually in breach of contract by asking for more money.
A contract is made up of an offer and aceptance. They offered the product to you for a fixed price and you accepted....a contract was made between you. The options are; 1) They swallow their 'loss' or 2) The conract is cancelled. What I'm not sure about though is whether they can cancel the order without your say-so. Any lawyers out there?? It sounds like Datamind are possibly one to steer clear of! Ian |

8.2 Any quotation or published price is subject to alteration or withdrawal without prior notice as a result of fluctuation in exchange rates, increase in supplier costs, error in published price or other costs beyond our control. Statement of price or a quotation does not constitute an offer. Reading through them makes for interesting reading - certainly don't think I'll ever deal with them. Thanks for the 'heads up'. |

Reading their t's and c's makes interesting reading. I have grave doubts over the legality of quoting a price for an item (verbal and written!) and claiming that you are free to change the price whenever you feel like it.
I'm going to make a wild assumption here, I bet Datamind have never reduced a price to customer who has ordered something and Datamind have then managed to buy it at a lower price - they'd claim it was tough as you ordered it at the higher price. C'mon there must be some legal eagle out there who can comment on this! |
