Not necessarily.....a road accident after a party he will have had to blow a breath test.....he could be in custody still because

a. he is denying the charge as you said
b. he failed the breath test
c. he refused to take the breath test.

Well Im not a Policewoman so I cant say for sure but I always was under the impression that time limits are extended in extenuating circumstances. And also in more serious cases than a simple car incident/assault.
