If they include leaving the scene, failing or failing to supply a breath test and/or failing to report an accident, I think he's a gonner...If it's more straightforward and is just a case of some idiot stepping in front of the car with nothing else to consider it shouldn't be a problem. It's not encouraging that he's still in custody though.
