Mis-sold phone, can it be returned

i recently ordered the nokia n900 of nokia retail.co.uk the tarrif i selected stated unlimited internet, and did not mention any fair usage policy, i now find out, after contacting vodafone that the data plan has a 500MB limit, is this classed as being mis-sold and even though i have opened the phone and used it, would i be able to return it and cancel my contract?
oh and if anyone wants to see it, this is the page where it states unlimited data

Three also say unlimited Internet but think its only 1GB limit I wonder if any one has ever gone over this and what have three done to you?

Its not a limit though, its 500mb FUP.

I'm on Vodafone and regularly hit about 800-900mb a month, I've never heard from them or been charged extra.

You would need a very good lawyer and a bucket-load of cash to take on Voda's legal team on that one.

It would set a massive precedent if you won the case though.

Nope. They say 'unlimited' but theres always a Fair Usage Policy same with 'unlimited' texts.

If it's a new contract you usually can return it within 14 days and cancel the contract just paying for the calls and internet used.

As legends wear 7 has said; 500MB is a Fair Usage policy and if you were to exceed this you wouldn't be charged any extra. If you were continually exceeding this usage then we would contact you to offer you a more suitable data option.

Ok thats fine as long as I wont get charged for occasionally going over the 500MB thats ok. I have setup a datacounter on my homescreen on the phone so I can keep track. thanks for your response.
