Mis-sold phone, can it be returned
i recently ordered the nokia n900 of nokia retail.co.uk the tarrif i selected stated unlimited internet, and did not mention any fair usage policy, i now find out, after contacting vodafone that the data plan has a 500MB limit, is this classed as being mis-sold and even though i have opened the phone and used it, would i be able to return it and cancel my contract?
oh and if anyone wants to see it, this is the page where it states unlimited data http://www.nokiaretail.co.uk/Brands/...nt_n97_wrapper |

Its not a limit though, its 500mb FUP.
I'm on Vodafone and regularly hit about 800-900mb a month, I've never heard from them or been charged extra. |

You would need a very good lawyer and a bucket-load of cash to take on Voda's legal team on that one.
It would set a massive precedent if you won the case though. |

If it's a new contract you usually can return it within 14 days and cancel the contract just paying for the calls and internet used.

Hi K3ckham,
I understand that this situation must have left you feeling quite frustrated. As legends wear 7 has said; 500MB is a Fair Usage policy and if you were to exceed this you wouldn't be charged any extra. If you were continually exceeding this usage then we would contact you to offer you a more suitable data option. Please let me know if you would like to discuss this further by contacting - Web Relations Team - Vodafone UK (When contacting, please quote the code WRT135 in the subject line. In the message body, please include a link to this thread and your user name.) Apologies for any confusion that may have been caused. Thanks, Espi Web Relations Team Vodafone UK |
