Italk
has anyone had dealings with Italk, I am trying to help someone in their 70,s who somehow signed up to them by pushing the wrong button on their phone and are now signed in for 2 yrs they only have a couple of months left of the contract but the company comes across as a scam, and very unhelpful.i dont think they act outside the law just very close to it and are morally corrupt.

I see their web site says they are very helpful!!!!
" We pride ourselves on offering you fantastic customer service combined with great value phone calls. When you ring us, our UK-based team will understand exactly what you need and will make sure you come away from the phone call happy, with your query answered. Rest assured, with italk, all your phone needs are taken care of. Choose a package that suits you perfectly." One to avoid then |

By the sound of it, they will not reply and will then auto-renew the contract (by denying all knowledge of the letter). The copy letter can then be used if necessary to refute any claim for breach of contract charges. italk Unit 6, Gemini Centre 136/140 Old Shoreham Road Hove East Sussex BN3 7BD Quote:
9 Ending the Telephone Service I suspect it's no accident that the specified website address given in 10.1.1 above returns a 404 Page Not Found!9.1 You may terminate your contract at any time in writing. You will be liable for all charges and fees for the remaining term of the contract. 9.2 From the Activation Date, we will provide the Telephone Services to you unless and until they end in one of the ways described below. 9.3 We can suspend or end the Telephone Services immediately if: 9.3.1 if you break any term or condition of this contract; 9.3.2 if you fail to pay the sums due for the Telephone Services after we have written to you to tell you that your payment is overdue or your chosen payment method seems not to be valid; 9.3.3 for reasons outside our control, we cannot continue to provide the Telephone Services; or 9.3.4 you use abusive or threatening behaviour while using the Service (including to our customer service agents). 9.4 If we end our contract with you under clauses 9.3.1, 9.3.2, or 9.3.4 we may charge you for any reasonable costs we have to pay to disconnect you. 9.5 If we stop providing the Telephone Services under clause 9.3.3 we must give you at least seven days' notice in writing. 9.6 Upon termination of any Telephone Services for any reason, we will send you a Termination Notice and all sums outstanding and any Additional Charges arising as a result of such termination shall become due and payable immediately. 10 Contacting us 10.1 Written notices given under this contract may only be delivered by post or e-mail to the following addresses: 10.1.1 to us at the relevant address given on our contacts page located at www.italktelecom.co.uk/contact 10.1.2 to you at the relevant postal or email address provided as part of the details which you submit during the registration process or any alternative address that you provide to Italk. 10.2 Notices given under this contract must be made to Customer Services. You don't say whether your friend also has line rental with iTalk or whether they just use iTalk as their CPS calls provider. If the former, arranging for another line provider to take over the line will be necessary and, if that's to be BT, calling and asking for them to take over the line on a 'return to donor' basis on the exact date will probably be easiest. |

She only has the calls through Italk bt provide the line,
we have been advised to write in May 16th to end the contract on the 23 June otherwise it is a rolling contract they have quoted £55 to end the contract early. Is a contract with no hand written (wet signature) legally binding? |

The fact that it's a CPS only contract and not line rental as well makes things easier. BT line rental comes with at least BT's Unlimited Weekend Plan which gives 'free' weekend calls of up to 60 minutes each to 01, 02, 03, 0845 and 0870 numbers. If it's true CPS (which I suspect it is) the 1280 prefix to cause an individual call to 'hop back onto BT' works now. I'd suggest trying at the weekend. |
