It's rare that you will get an established band with the same as another as the name will normally be copyrighted (?) when they sign a recording deal if not sooner.

However it's has happened. There was a case last year of the two band called Blue, the boy band and a Scottish band who have been around since 1974. This went to court and they agreed to share the name providing it was made clear on advertising etc. Also Liberty X were originally called Liberty until a court case a couple of years ago.

It's not new either, The Shadows were originally called The Drifters, and credited as such on Cliff's first few singles. However actiion by the American group of the same name resulted in the name change.

The Nirvana situation, I seem to recall was up in the air but obviously came to an abrupt halt when Kurt killed himself.

Bogus bands with the same name has also happened. In 1974 a band called Fleetwood Mac toured the states. They had been put together by the original Peter Green led band's manager as the real thing weren't really doing much. Also a bogus Deep Purple toured the states in 1980 fronted by the original lead singer Rod Evans. Both of these ended in tears.....

Most over-used band name...

Anything beginning with The, followed by a random other word. We could be here forever listing them.

Liberty X also suffered this same problem - they were called Liberty but they found out that some band was already called Liberty so they had to change their name. So the stuck an X on the end and here we are today - Liberty X.
