Could an iPhone 3g on IOS4 be returned under sale of goods act

I've heard this mentioned elsewhere but not sure if there is any truth behind it,

Under 1979 sale of good act the phone is no longer fit for purpose

Sure you can downgrade and all is fine but thats not the point, the apple forum has 15-16 pages of complaints from 3g owners so all are effected so swapping the phone will do no good. My 3G is 3 months old.

Doubt it as you can downgrade, you are not forced to use ios4. If there was no case with losing Linux support on the ps3 then there is none here too, and with that you were forced to upgrade unlike the iPhone.

Although you can downgrade you are not technically supposed to. And although you are not forced to upgrade I have encountered 2 apps, 1 being TV Guide, the new update means it won't run on 3.1.3 I get an error along the lines of

"Not supported with this version"

It isn't clear what would happen.
When the legislation was enacted the concept of firmware updates wasn't considered.
As far as I know, when similar situations have occurred the manufacturer has had to return the product to its original condition.

Apple still sign 3.1.3 so it's not that you 'aren't supposed to' downgrade they'd just rather that you had the latest firmware. Apple will presumably try to improve performance on the 3G in future updates. As for apps, that's basically bad programming from devs. There is no reason to drop 3.1.3 support. Can't see you being able to return it basically.

Also, I guess it doesn't help improve your mood that you bought a phone in April that's now two generations out of date and showing it's age.

I downgraded my phone and it works faster now than it ever did. The entire process took literally 5 minutes. Search on google for the step by step guide. It really is a piece of cake. Your problem will then be solved without drama.

I doubt it. It's similar to instances where companies buy a piece of software from a contractor then don't upgrade it for years and years and then the developer no longer provide support for it and your software no longer works.

With the sort of thing it's best to speak with trading standards, you might not be able to get them under the sale of goods act but there may be something else, a claim for damages maybe.

Or you could try the numerous fixes available. It works fine on 90% of iPhone 3G's so there can't be a 3G wide issue...

Just read on the Metro website - tech pages, that in the USA a case has been thrown out of court claiming just such a thing that iOS4 stopped the phone working properly and deleted paid for apps.

Surely that was known in April if thats when the g was purchased

Iphone 4 and O/S 4 were not secrets in the spring ?

Only if you read the technology news or subscribe to various websites. I'd say it's fairly obvious that the OP didn't know as they would never have bought a 3G in April if they did (unless of course it was cheap second hand from someone else - in which case, not such a big deal).

I bought the 3g as it was the only iPhone I could afford at the time, I didn't know about iPhone 4 in april

I have a 3G - i've actually found mine's slightly faster than with iOS 3, still miles slower than with 2.

I wonder if you have an app causing these issues? I found there were quite a few that really screwed the phones performance after the os 3 launch.

Hi there,

I upgraded to IOS4 on the day it was realised and straight away found the phone to become 'sluggish' like many others have encountered. I was so annoyed however, a week after the upgrade the phone lost all signal (WIFI included) and shut down having asked to connect to my pc and restore the phone.

Despite trying on several occasions, the restore stalled at 99% and came up error code 1002. I tried all the Apple call centres suggested fixes but eventually managed to convince them that the upgrade probably cuased the damage. They agreed to an out of warrenty replacement.

The guy in the Apple store didnt look convinced but swapped the phone for a brand new 3g. He didnt really check to see if I was telling the truth becuase I said I didnt mind waiting the 30 minutes it would take to attempt the restore, I guess I wanted to get on with his day and took my word for it

This is a little slower than id like but much improved from what I had before. The upgrade seem to run fine on the new phone even though its the same version.

Does this suggest that a more recently produced 3g is more capable of running the new firmware. Might be worth doing the same as me?
