iphone 4 reception problem,o2 refuse to take phone back as its from carphoneware hous

ok so theres people talking about this everywhere

im having calls drop out every time i use the phone, to be fair i dont see why i should have to cover a phone with a bumper as i use the sleves/socks
apple have admited a problem so i rang o2 to say they can have the phone back untill this problem is solved as i need a fully working phone
they say because i got it through carphone warehouse i have to go to them, i did and they say wait for apple as they are seem to think they can sort this with an update.
i cant see how as its a hardware problem

anyone else got any sense from o2 ??

have you sent it back ??

Sale of Goods Act. You bought it from the Carphone Warehouse, there is plenty on the internet explaining how the phone's design causes it so it is an inherent fault (and as it is newer than six months CPW have to prove it is NOT anyway) so take it back to there, though I'm not entirely sure where this would leave the contract. You might be able to drop to a 3gs or something.

i had the 3gs and was out of contract, waited for this phone, a little gutted to say the least, i have to call them back in a few days the man from CPW said,to see what apple say, i just dont want to be going through this for the next 21 months of my contract

I wouldn't ring, put everything in email/writing so then you have written records of it, then you can use it if you need to take it further and nothing gets misquoted.

Apple aren't fixing it by software - they can't - all they are doing is adjusting the signal strength levels, so your phone doesn't go from about 4 bars to none just by holding it. The attenuation of the hand is common in all phones, but none of them have an external antenna which shorts with the other antenna... that will happen unless some insulator is applied to the antennae, like a bumper, or some non-conductive paint or something...

Not sure how much it is now but the mobile companies seemingly made a loss selling the iPhone.
So who is paying all the refund costs?
Maybe wait a few days for full disclosure of the refund offer.

It would be quite weird if you could have the phone for a month free as many might just do.

According to a post there you get 14 days to return it minimum.

OP would you buy a gas cooker from Currys and then try and take it back to British Gas if there was an issue with it as that is pretty much what you've just tried to do.

Your contract for the service is with O2 but your contract for the handset under sales of goods act is with where you bought it from ie CPW

Well I'm certainly confused by this contract scenario.

With probably 95% of iPhones bought under contract 'no 30 day cancellation of contract' could render the refund offer totally worthless.
With little information one can't help but wonder if they are hoping it stays low on the media radar.
Thus the refund is not a refund just like the fault is not a fault.

I must say I'm very confused by all this too. Apple promised people who are not happy could return their phones. They really should take this on the chin and cover the resellers. Big networks like O2 should be ashamed of themselves if they try and stall this past 30 days then say tough luck. Even though I'm happy with my phone, this sleight of hand they are playing is unacceptable IMHO.

Surely it's best to contact your local trading standards, they'll tell you exactly where you stand and what you can do. They also tend to focus the minds of those who won't play by the rules.

Er...there was No equivocation, you can have your money back if you like. Apple will sort it out with the dealers & networks. It's not too much to ask to return it to the place it was actually bought from though is it? Stock control and all that. CPW sales droid was just trying to get you off the phone because they haven't been told what to do yet. It'll be fine.

The CPW are well within their rights to tell you anybody wanting to take back an iPhone to clear off. Apple have said you can bring it back within 30 days. Nobody else.

I guess the only come back for customers who have not bought from Apple is through Sale of Goods.

That contradicts itself, if the fault is inherent in the product and repair or replacement of the product will not resolve the issue (as in the iphone 4, since they all do it because of the poor design) then legally you are entitled to a refund.

The issue is that after Steve Jobs spoke if was asked if this applied to people who bought a handset with a contract. He said 'Yes, I guess so'.

This was the first the networks had heard of this and, quite rightly, they have to work out how they are going to respond to this. None of the UK networks have said what they will do. Indeed O2 are the only one who've said anything so far.

Knowing how the cult of Apple works, iPhone owners are now blaming the networks for not having procedures in place for something they had no idea was even going to be announced.

But they legally cannot wait until they have heard what apple say! They need to repair, replace or refund the handset, or prove the handset does not have an inherent fault, without causing you "undue inconvenience". That is the law. No network, CPW or Apple can over-ride that.

You say the phone is dropping calls 'all the time' (those are your words), are you saying that the phone is not working as a phone? Can you make a call? Does your phone ring at all when you try to ring it or does it automatically redirect to voicemail?

I would take it to an Apple Store and get it changed for a new one, Apple will swop it for a new phone straight-away. It does not sound right to me at all, I have had the 4 since launch day and never had a problem with it.

I think your phone is faulty to be honest, if your dropping every call then there is something wrong.

Agree I'm not in the best 02 area, get 3 bars at the most with 4.0.1 and have yet to drop a call.

im on 4.0.1 aswell, and if i have the phone in either hand, mainly left one (without any case ) the bars will drop one by one to the point where it loses the call then states no service

if i put the phone down as soon as this happens i can watch them come back.

a friend of mine has the 32gb version and does the same, he got his from phones for you and is going through the same problem

just got off the phone to apple, very helpfull i must say, i told him what was happening to me and he openly admited there was a 1 per cent out there who was losing signal totally as i do when holding the phone without a case, he told me to get to my nearest apple store and they will swap it over for a new one, i was given a csae number

he claims that the most it should drop it 1 maybe 2 bars, but where i work i normally get full reception.
time will tell as ill test it infront of the apple store person

Possibly right then what users say here with the massive variation in the lemon effect.

Is it the lucky ones who only suffer a 20db loss that the phone copes with?

Buyers will then insist on seeing the reading when buying second hand.

Apple has purposely made it impossible to properly test the iPhone 4.
