HTC desire issue.

Hello im needing some advise regarding HTC.

I have had a htc desire for about 3-4 months, 2 of those months my desire has been with htc to repair a problem with the phone not being able to select or keep a 3g signal.

The phone has been with HTC on 2 separate occasions and I received my phone back today and hey presto the problem is worse alot worse.

For some reason now the problem seems to be very similar to the iphone 4 antenna issues. when i put the phone on my bed, i have a full 'H' signal, if i pick the phone up that signal just vanishes. It still doesnt show 3G it seems to hop straight from G to H.

I went into the menu for signal strength it hovers around -81dbm to -90dbm and it shows a full signal when the phone is sat by itself, when i pick the phone up this shoots up to -111dbm and looses all signal, if i put the phone back down the signal shoots straight back up.

I have been told by HTC that they have a 3 repairs rule, where they have to be allowed to repair the phone 3 times before they would even consider replacing the phone.

Does this breach any kind of uk consumer protection act, have i not been flexible enough with them in not having my phone for nearly two months, i bought the phone sim free so i dont have the buffer of a phone network to help in this situation, but at this moment in time im starting to think that this might not be a fault and an actual design flaw.

I mean if they havent repaired after the second time then whats going to make them repair it after the third time, plus im not best pleased with them as they have over tightened a screw which has resulted in the plastic on one side of the phone to bulge causing the battery cover to no longer line up with the phone.

Should i ring them in the morning and have a firm talk with them, if anyone has got any advise as to what i could say to them to help me get a replacement or a refund then that would be great.

Other than HTCs shoddy customer service i do like my desire, i just wish this could be sorted.

I know the phone is Sim-free, but what network are you on and have you spoken to them about the signal? The reason i ask this is because there may be something that is affecting service in your area, or you could be on fringe coverage which is why the signal drops when the phone is in your hand. I complained about Orange's signal and had a call back from their engineers to confirm there was an issue in my area and to thank me for bringing it to their attention.

I had tried the phone with all uk networks, exact same problem with each one, my iphone 3g has no issue with the signal with the same sims, HTC kept saying the phone is faulty but couldnt seem to repair, they wanted to repair for a third time which wasnt acceptable.

so i rang amazon where i bought it from, no messing from them told me i could return for full refund which is extremely good of them. so as of now i should have my money winging its way back into my bank account.

SO i went and bought the new orange san francisco for £99 got it unlock for £2 and put my giffgaff sim into it, cracking little phone, full 3g and 3g+ no issues with signal, i am now a happy camper!
