Apple's marketing was always about giving their customers something special, which will cost them an arm and a leg, but which means they are getting the bestest quality possible, because quality costs and it means it must be good when it is so expensive, right? Now phones like Samsung Galaxy S2 are slowly getting the same cult status as iPhone once had and Apple has to react otherwise their marketing does not work anymore and people go elsewhere. It used to be simple for Apple, because there wasn't that much of a choice for the customer and iPhone was really better than most other phones. Now there's a lot of Android phones that are as good, but for more competitive price. Maybe even WP7 can have a shot at a bigger share once Mango is out.

in this case is more likely the patent 'owner' unwilling to take a license. They're certainly not obliged to. More info e.g.:

It's worth pointing out, in case you're not aware, that FossPatents is a blogger. He is not a patent lawyer, so whilst the info he presents is interesting, it should all be taken with a pinch of salt.

I do see a rebound for Microsoft coming. There is clearly a massive difference between WP7 and iOS, something not quite so clear cut between iOS and Android. Google really should have done the same as Microsoft and engineered a completely different interface, which would have left Apple's lawyers pissing in the wind. Instead they came up with something that's clearly "influenced" by the iPhone. It's left their hardware partners exposed, and I can see several of them turning to Microsoft in the next couple of years as a result. Especially if the Nokia/Microsoft tie-up starts to make inroads into the marketplace.

If you look at history no one ever sued.
We had lots of Cola in red cans yet everyone still bought the real thing. And unlike phones there was no need for such colour schemes.

Considering Samsung GUI is considered unpolished and inferior to such as the Sense GUI will the 5 thus get a needed GUI refresh to inspire the queues?

According to a slip by Al Gore (an Apple board member) it could be iPhones.

Which would seem to confirm the confusion over an iPhone 4s (similar to the 4) and a slightly larger iPhone 5.

I don't read too much into that. Even if it's only one model we can all assume Apple will be making more than one actual unit, therefore it's a plural whatever their plans are.

There is no patent though. The patent that was upheld was to do with google. Not samsung. The photo gallery that comes with 2.3.3 on the galaxy S2 is the stock android one.
