I'm guessing it's an unpublicised rights issue - if so, it would be nice if this was made clearer rather than a meaningless error message at the point of playing. I've contacted Netflix's UK Twitter support account about it but haven't heard anything back yet.”
Netflix support eventually got back to me with the unhelpful generic response of 'turn it off and turn it on again', which would have been relevant if I was having trouble accessing
all content, not just a few isolated cases. I tried it anyway, but as expected it made no difference.
However, I have subsequently managed to find a way of playing these rogue items. My normal practice is to use the button in the middle of the four-way control on the Apple TV remote to select items on screen and drill-down through menu options, and I usually drill-down all the way to the programme description, which is when I was getting the error message. However, I have discovered that if I press the play/pause button when the programme icon is selected (i.e. the menu level above accessing its description), I am able to play the programme. Not sure yet what will happen I get to the end of the first episode of Breaking Bad, since I can't currently access the series list, but keeping my fingers crossed!
Surprised more people haven't encountered this problem - maybe I'm the only one contributing to this thread who isn't accessing US content on their Apple TV! - but hope this info will be of help to anyone who is.
