are people downloading these versions thinking they are the originals?

Or just downloading them because the original hasnt been release yet?

Seems silly of Maroon 5 to hold back the release date of the single when so many "fake" versions are out.

And how do these tribute acts get the rights to sing and release a track that M5 have not even released yet themselves?

It's probably a combination of both the reasons you mentioned. Some people think it's the original, others just can't be bothered to wait for the original to be released, so would rather buy a version that sounds almost the same immediately.

Not sure about getting the rights, but Glee Cast have sometimes released covers of songs to UK iTunes before/at the same time as the original (e.g. Jar of Hearts and We Are Young). They've also covered and released songs that have never even been released in the UK (e.g. Run Joey Run I think), so it must be legally possible somehow.

Is that why Whistle was brought forward? Cos iirc there was a cover at like #15.

I believe it's the case that as long as the original version has been released somewhere, these 'tribute' versions can be made available.

Those "tribute" versions are awful. I remember waiting for Katy Perry's Part of Me to be released and before the original song was even released there were loads of awful cover versions floating around iTunes. Needless to say I waited for the real version.

They are the new import singles! (They were prone to sneaking in the chart between 1999 and 2001.)
