One Direction vs One Direction - Big Lawsuit!

One Direction US have the official licenses of the name, so personally I don't think Cowell has a leg to stand on with the 'explotation of good will' lawsuit.

Cowell is just scared that he now has to change a well established brand. If US One Direction can prove they have licenses etc prior to September 2010 then there will be no issues and they will win outright.

Nothing will change for the brand though? It is most likely that they will drop the 'One Direction' and be known as '1D' which everyone calls them anyway and they use on all their marketing products and branding.

This case has probably been sorted anyway, but they are using it as spin..

errm, but he is counter suing them. Surely he would have settled quickly if he was scared and not confident.

U.S group probably were not expecting this move. I hope they have some rich person backing them. Sony have some of the best lawyers in the business.

They would probably get away with 1D but its incredibly thin ice when you consider what it stands for.

One Direction US are obviously not willing to negotiate on it so it might not be as simple as an out of court settlement. By countersuing them he's just putting the case forward why they shouldn't have to change their name, ie that they're a bigger commercial band. I do think that Simon will win this one though.

Of course they want to negotiate, why else would they ask for $1million? They were ignored by the Sony lawyers when they approched them, and rightly so.

If they were willing to settle it out of court they'd end up getting less than $1m and probably lose the rights to use the One Direction brand because both sides want it, otherwise One Direction US wouldn't want $1m and an injunction on the use of the name.

The injunction is an extra demand to give them weight in a potential settlement. Just because they asked for it doesn't mean they actually want it!

Its really quite simple, there will be a negotiated settlement,

US one direction and just stretching this as much as they can, the likelyhood of this ending up in court is very small

the obvious solution would be to amalgamate into 1 super-boyband, of 10. They could do stadium concerts on a revolving stage in the middle of the arena with one lot facing one way & the other the other....and be called 'Two Directions'
