Jessie J being sued
[quoted from DivaDevotee, who wrote the blog entry based on a Guardian article] Quote:
Oh dear, looks like Jessie J is being sued for copyright infringement. The song in question is her second UK number one hit-and no favourite of mine- 2011's Domino. Bright Red Chords: http://www.youtube.com/watch?feature...&v=eE-sVIr_9kwThe song sure did remind me a lot of Katy Perry's Last Friday Night (T.G.I.F.) when it was released, but as it was produced and written by the same people- notably Dr. Luke- it couldn't really be deemed plagiarism or infringment. More sloppy seconds, if you will. However, things have heated up now, with American singer Will Loomis, claiming that the hit single borrows heavily from the song Bright Red Chords he released in 2009 with group Loomis and the Lusts. As a result of the claimed infringement Loomis is seeking at least $150,000 (£96,000) in damages. Is this a case of a relatively unknown courting publicity by attacking a bigger fish, or do you think Mr Loomis is right to bring his concerns to trial? Take a listen, vote, and let me know what you think in the comment section below. I can see the similarities in the verses, however I'd put this more down to the utter simplicity and generic melody of both songs. |

The thing is though on the verse, it's nothing unique if that makes sense! It's just a lower tone that goes higher, in Domino the "I'm feeling sexy and" is low and then "free" is high. It's like, it's not even hard to come up with?! It just sounds generic regardless.

Here's the thing, this happens all the time. Mostly with things produced by Dr. Luke. He was sued for a Britney song about 2 years ago. California Girls is the exact same as Tik Tok. It even happens with things not produced by him. Adele's Set Fire To The Rain is the same as Jessie J's 2010 song, Do It Like A Dude. It might not seem like it, but http://www.youtube.com/watch?v=b3io8...9RccBOouxAhMDw
If it is true that it was stolen I would have to look towards Dr. Luke. The bright red chords song was supposedly played in the Forever 21in 2009 in either San Diego or Santa Barbara, one of the two, cant remember which. It's possible they heard it there or on youtube. I find it weird there is a lawsuit since that melody is used in at least hundreds of songs, specifically in the late 60s. I find it weird Loomis has a copyright on it and is just now suing someone since it has been the go to tune for pop songs by Dr. Luke for a few years. I also find it strange that he said he heard Domino before, but didnt decide to due until he heard her sing it at the Jubilee. Domino was a popular song in America for quite some time. I live in California also and it was on anytime you turned on the radio so it is strange that he didnt take immediate action. Not to mention it was on tv quite a lot and Jessie sang it on two of the most popular tv programs here. |

Has anyone seen their twitter? http://twitter.com/loomislust/ They are milking this for all it is worth. It's rather noble of Jessie J to have stayed quiet about it thus far. She could have easily went into a tirade and made herself look like and idiot.

Ooh this interesting. Hopefully she'll get dumped by her label and we'll never have to hear her dreadful warbling ever again.

To be honest, I don't think plagiarism is in effect (did Dr. Luke also write this song...?), I just think the two songs are so utterly generic and simple that a coincidence has formed. It's not exactly a hard hitting, innovating melody.

dont be rude and she wouldnt get dumped by the label for this. If it was stolen it was by the producers...which the label hired.
![]() Am quickly getting to the opinion that Dr Luke isn't exactly appreciated that much - a bit of a liability as far as his work for these Major label's.Think this band may be trying to take advantage of the point that Dr Luke does tend to make large use of derivative works in his own music, although possibly having no case here. |

Doesn't help with her credibility as an individual artist though does it - working alongside such thief's, allegedly

The labels hire him because he's a hit maker. That's just what he does, even if he steals music. Most of his songs sound the same. California Girls and Tik Tok are the exact same song. He didnt even bother changing anything at all. I think he just picks a tune for the year and runs with it. Just like TGIF and Domino are the same.
