Cancelling/new account with O2 question, please

I have an iPhone 5.
Renewal date is September 2014.
Phone is OK but I'd prefer a bigger screen phone.

I asked O2 what the financial penalty for early upgrade would be.
There isn't one, because no early upgrade is possible.
They said I could cancel the contract and take out a new one.

At this point, the system ate the connection to a Live Assistant.

I know I could start over but I thought I'd ask DS experts first:

Supposing I do decide to do this, come September 2013, say.
As I understand it, the penalty for cancelling would be 12 X monthly payments.
My question is: Would the iPhone then be mine? Or would I have to return it for an upgrade?

Yes, I know it's a daft idea, a lot of money, just because I'm a gadget-whore; but I'm hoping come September 2013 to be celebrating the successful end of medical treatment, and I might just think WTF, and treat myself as a celebration - particularly if I then have a phone to sell to partly offset.

It would be your phone if you cancelled the contract with them and paid off your bill.

So if you want to cancel in September 2013 you'd have to pay off your contract. So say for example you're paying 36pm you'd pay 36x12= 432. You'd probably get a slight discount on cancelling early so it'd be more likely to be around 400.

Then you'd have to sign up to a new contract to get a mins/texts/data allowance + a new phone.

OR

You could just sell your iPhone 5 for say 350-400. Then buy a new phone at the same cost and fund the difference yourself if it's more expensive. Then use the new phone on your current 36pm contract and get to upgrade to a new phone come sep 2014 as normal.

I don't know if the terms and conditions say you can't, but considering the number of S4s and iPhone 5s that pop up in places like CeX they obviously don't care.

As long as you pay the bills they don't care what happens to the phone.

If O2 really wanted to they could see if the phone is being used on someone else's account (if they were also on O2) but I doubt they bother.

correct.

A common misconception is that it's illegal or wrong to sell your phone during a contract.

You can do it. But you also have to keep paying your contract/pay off your contract.

Just make sure you get O2 to unlock the phone first so that the buyer can use it on the network of their choice without hassle.
