Sony Erikson K700i
Hi,
can anyone suggest where I can buy a NEW k700i, preferably simless, otherwise pay as you go?? I searched all over the net but the best I can find is £149 from Orange. I believe these are locked so you can't put games on them though ![]() Cheers Dweeb

Just don't put it on O2.
They're temporarily pulling it off the market because of problems with SMS receiving. Catch Watchdog tonight at 7pm on BBC1. |

I'll be selling one soon on ebay if your interested had it for 1 month reason I'm selling is I want a Samsung D500.
it's on Orange but I've unblocked it so you can use any sim card, T-Mobile, O2, Vodafone. not got the D500 yet so it's not for-sale yet though Steve |

yeah... you can download games from any wapsite, or via IR or bluetooth.

i believe that watchdog was tellin people if they had this phone on 02 to get in touch with whom u got it off and there is a list of new phones you can change it for free fo charge

From the watchdog programme the other day it sounded as though they were saying that it was only some K700i's that had the problems. If they switch it for a new one and that still doesn't work then you'd be able to use that switch as justification for exchanging it for a different model. OTOH, if it works after the switch then you'll have a working K700i anyway so why would you want a different model?

O2 Swapped my K700i three times and all three were faulty, my brother also has a faulty one, so theres 4. I dont believe that its just 1% thats faulty.
I now have a S700i that O2 sent me - I think just too kepp me quiet andto leave them alone. Watching Watchdog on Tuesday was great and I hope O2 get their asses kicked! |

If your phone does not work properly then 02 are not fulfilling there contract. The key is you have to say the SMS part of your phone was and is vital to why you purchased your phone. If you can say that the SMS function was and is so important to you owning this phone it becomes as important in the contract as the ability to make a phone call with it. Therefore o2 are in breach of contract section 14 sale of goods act and i think it is section 13, section 14 is the phone is not of satisfactory quality and I think section 13 is that the phone is not fit for the purpose you purchased it. O2 and many phone companies constantly breach these contracts with idle threats of you owe us money if you cancel this contract. O2 are in breach of basic Sale of Goods Laws the phone is not of satisfactory quality and the network is not of satisfactory quality as you cannot use your phone. Also all shops are scared when you can walk in and quote law at them. Hope this helps some people James |

All well and good in theory but unfortunately it's not quite that simple, O2 would claim that the phones are fit for the purpose that they were sold & there are millions of customers using their network so there is nothing wrong with that either, they would technically be correct in both cases as the phones aren't faulty, there is just an incompatability that sometimes occurs between the O2 network and the phone. You would need to somehow show that a reasonable person would conider that the incompatability means that the goods aren't reasonably fit for their purpose. Also things like time periods, acceptance of goods and if you were made or should have been aware of the compatability issues at the time of sale would be taken into account.
You should also be aware of any other legeslation that might be relevant or relevant terms in the contract that was signed, or terms and conditions of use (i.e. if it says they can they replace a 'free' contract K700i with a 'free' Sendo thing, offer to repair it, give you reconditioned goods etc), though these could fall within the remit of Unfair Contract Terms Act 1977. Remember though you can't force O2 to do anything, only a court can do that if a case is brought against them and is sucessful. I'm not saying arguing the sale of goods act with them won't work, just know what angle you are coming from & be prepared for their counter arguments. Don't just quote the law at them, they might just quote it back at you (as I have done a few times with really annoying customers when I was in retail). For example don't just say the phones are faulty and under the sale of goods act you want a replacement, say that you believe that under section 14 (2B) (a) of the Sale Of goods Act 1979 the phones aren't fit for the purpose of 2 way SMS communications via O2's network, which is one of the primary reasons you purchased the phone. BTW if anyone wants a copy of either the Sale of Goods Act 1979 or Unfair Contract Terms & Conditions Act 1977 let me know, they are quite heavy reading though. |

I have not had a problem with the SMS, but then I don't use it much. The problem I have with the phone is that it will look like its working, but if you try to make a call I find I can't, and I have to turn it off and take the battery out. Also when it does this, I can not receive calls, which is vey annoying as I don't know about the problem untill someone calls the home phone or I try to make a call.
It also crashes where you can not do anything. It doesn't happen that often so I have lived with it as apart from these faults and the poor battery life, I love the phone. |
