3 mobile changes terms and conditions.

on the 17 January 2005 I needed to contact 3 Customer Services. Which lets face it is kwap.

They informed me that since November 2004, 3 had been charging for calls to 0845 and 0870 numbers.

I had not received notification of this. And I rechecked all my bills and accociated documentation and could not find any reference to this.

Have any body else been informed of this change to there terms of service. ?

If so how did 3 notify you of this change?

I heard about that on another forum. It was my understanding, however, that 0845 numbers came out of your inclusive minutes and 0870 numbers were charged outside of them. I haven't had to ring any of those numbers recently though to see.

Anyway I thought calls to 3 CS by calling 333 from your phone were free, or at least came out of minutes. One or the other?

if the company has changed its t&c to your disadvantage without nortifying you then you should have the right to cancel the agreement with them, i know that vodafone and o2 state this in thier t&c

The T&Cs/price guide when you signed up in the first place did not mention that non-geo and 0870/0845 numbers were or were not included in your inclusive mins. Three didn't start charging for them till end of November due to a system error.

You took it for granted.

As they were not an integral part of the T&Cs, and a Price Guide, 3 are well within their rights to start charging you.

In an article published by the "Money Saving Expert" dated 29th Febuary 2004 and revised on the 7th July 2004 it clearly states the following.

"3’s inclusive minutes include calls to 0845 local and 0870 national rate numbers."

Further to this I have examined the PDF document of 3's charges that were in effect when I reqistered with 3 and calls to 0870 and 0845 numbers are not listed as seperate numbers. Also the revised document for september 04 the same applies.

However it does list chargeable calls to certain numbers which are not covered by the inclusive minutes and 0870 and 0845 numbers are not listed in them.

Furthermore the company I took a contact out with for 3 were unware of this change and its a big mobile supplier.

So I DO NOT THINK I TOOK ANYTHING FOR GRANTED"

They were the terms and conditions that were in force when I signed up with 3.
If 3 then change them surley they have to notify the user of these changes. Especially when they involve me incuring extra expenses.

I have written to 3 customer service asking for an explenation of this. So I will wait to receive a reply.

Please point me to where it says in the T&Cs for Three about them having to notify you of pending or new price changes? I don't think they have to.

(Variation to Your Agreement or Prices)


b. we will let you know at least one month in advance if we decide to discontinue your Price Plan or if we make any variations to your agreement which are likely to be of detriment to you.

If further goes on to say I can terminate the agreement for such variations.

My original question asked was were any other 3 customers informed of this change.

I did not receive any replys to this. (thank you very much) Instead I received an abusive comment from one person answering my post.

However this evening, I spoke to a existing 3 customer and she was not aware of this change i mentioned in my original question.
I now have her contact number and she will back me up in my complaint to 3.


The point is, I have has an appaling level of service from 3 in the 7 month I have been with them. Not once have i had an appology or compensation from 3 even though I was without a working phone (outgoing (could receive)) for more than 3 weeks.
In 10years and 1 month of using GSM mobiles I have not had to contact customer service as many times as I have had to in 7 months of using 3.

If you think I HATE 3 you are incorrect.
Its just the customer service thats kwap.

Even if the T&Cs don't mention if 0845 & 0870 are included in monthly allowances, could it not be viewed an implied term that they are included in this case and for other people who signed up x amount of time before 3 changed it?

If it can it doesn't matter if 3 has it specifically stated in their T&Cs or not, they can still be in held breech of contract. Also, as far as I know, under English law lots of contracts are verbal, all the written down bits constitute only a 'statement' of what has verbaly been agreed. So, even if something isn't written down, but you were told it & agreed to it when you signed up and can prove it, it would be a valid term within the contract.

BTW, I should state that I'm not a legal professional.

Why is every one so edgy?
Abusive comment? I was accused of attacking someone yesterday as well.

Honestly. You can't say anything nowadays without someone trying to cause a scene.

I'm glad you've finally corrected me.
