Cheryl Cole faces Simon Cowell in £3.5m US X Factor court fight

Quote:
“Cheryl Cole will finally come face to face in court with Simon Cowell as she steps up her £3.5million compensation claim over her humiliating US X Factor sacking.

The 30-year-old singer has refused point blank to settle with makers Blue Orbit and instructed lawyers to quiz the music mogul along with judges LA Reid and Paula Abdul on how much they earn.

A Los Angeles judge gave her the green light to see the trio’s contracts. She will call Cowell, 53, as key witness.

But fans hoping for a public airing of The X Factor chief’s wages are in for a blow - Judge Abraham Klein ruled contract details must be kept secret.

Cheryl’s deals will also be kept from the public – along with payout details if she wins the case.

An insider said: “This paperwork is a clear sign that Cheryl wants her day in court. She is pushing for full fees… £2million, legal fees and a bonus, which could total £3.5million. Cheryl will learn what Simon earned and her co-stars too.

“Those papers could be the smoking gun if she can show others have been treated differently to her. The confidentially of discovery order means much of his *testimony is unlikely to become public. Had it not been signed, the trial would have been the most explosive reality show trial.

“Every aspect from pay, expenses, contracts and personal *requirements of the stars will be released.”

Cheryl accepts she was paid her full £1.2million wage despite only making a brief appearance on US X Factor. But she claims she was promised £1.5million for a second series whatever the outcome of the first.

Blue Orbit insist she was treated fairly. If Cheryl loses she faces a £1million bill from her legal team plus Blue Orbit’s costs.”

Its the production company shes suing.
But why on earth would they have promised her £1,5 m for a second series?

At the end of the day, I know it's her own business, but I don't see why on earth her case entitles them to look at LA and Paula's contracts. As I understand it, each individual negotiates their own contract - hence why you always hear of judges getting differing amounts to others (e.g. Louis not getting a pay rise). If Paula and LA got different expenses and allowances - that's because they've negotiated for that surely?

I think the Friends cast have been one of the few exceptions on television, because they negotiated all together instead of individually.

I hate sensationalist stories. The way it goes on about 'she'll finally come face to face in court with Simon' - it's well known that she and Cowell are very good friends

A settlement still seems more than likely. As for this "production company" that she is suing, I wouldn't be surprised if ultimately that was somehow connected to Simon.

Someone suggested to me perhaps she is getting to see the other judges contracts to prove that it wasn't just a clerical error on her contract, like Blue Orbit are trying to suggest. Paula might have got paid for season 2 even for not working it, so if she did and the contracts prove it, it makes Cheryl's case stronger.

I hadn't thought of that!

It's odd (if all this is true) that they made such a mistake with the US contracts considering, as the UK press reports each year, the XFUK judges only get a one year contract and that's it. By the sounds of it, and if it's true that Paula got paid for season 2, then they were really wrong in being so convinced that the LA, Paula, Cheryl line-up was going to work long term. They must have lost so much money, especially when you factor in Britney's wage.

Despite everything, I think it's quite telling that this production company haven't settled yet. I thought they probably would have done by now, but they must feel they have a good case also.

If she loses the case, it will break her.
