OK I'm about reaching the end of my patience with o2

Problems I'm having today:

Cannot receive calls (Though can make them)
Text messages being delayed by about 2hours
Dropped calls
It's getting beyond a joke now, my handset has been repaired twice and the conclusion from the o2 shop is that its a network problem. When people ring my number, theyre just hearing a long dead tone (even though voicemail is switched on and activated)

As they're not providing me with the service I am paying for, am I entitled to cancel my contract with them? Anything's got to be better than this, its taking the p!ss!

Try your sim card in another phone (unlocked or on O2) This should tell you if its an phone or network problem. I suspect it will be the network or maybe even the SIM?

O2 is always having problems regarding capacity. I'd recommend trying the sim in another phone too.........what phone are you using?

Have they issued a new sim to you?

They should have.....

Call O2 0161 705 5000 and explain the problem.....

It might be an idea to try another o2 sim in the same area and see if the same fault happens.

I'd put money its the sim profile.....

Take control !

Its your bank, cancel the DD, send a recorded letter to SP providing details of problems and consequences if it aint fixed by deadline.......look up contract law and associated rules on dti site.

Hi Lee, me again. We are still having the same problems I see. I assure you it is not a network problem. My phone has been sent away for a second repair also. I am currently using my SIM card in my wifes brick Nokia 3310 s once again they had no phone to loan me and I am having no problems at all with it.
Does your phone keep switching itself off as well, sometimes on and off? I am getting calls diverting to voicemail even when I have a full signal on the phone with O2 logo present. I am constantly getting "searching" and "limited service" errors.
I have sent several emails to O2 and keep getting back standard cut and paste emails. Thanks to Steven who has also replied under this thread I have got some info about The Sale of Goods Act 1979(as amended). Unfortunately I think my emails are going to India or somewhere as all replies have asian names. I am getting nowhere with the monkies at that centre anyway.
I have said if the phone comes back and displays the same fault then it is therfore inherently faulty and I want a replacement phone. Fingers crossed for now.

Simon;

Yes, I'm having those exact same problems too. I'm a law student, so considering going down the SGA79 route "Not fit for its purpose" etc. though I'm not sure if o2 will bite.

If they do not offer me a replacement, I am going to cancel my contract.

It's concerning me that tomorrow I'm travelling half way across the country - I need my mobile to support me not pack in!

Im finding im only trusting the 02 service 98% not the 100% that I was a few years back. I to with my old Siemens C45 that I thankfull no longer have was having problems with it and at times was finding customers service would be helpful and other times be of no help at all. Emailing 02 from there website dose not always get a good reply. My Sony Ericsson T230 works 99% of the time. In the past 6 months I have found the 02 Network as a hole only to be 98% working and an odd time 99%. Im on pay and go.

Got my samsung e800 back after a second repair and guess what? it is still faulty. I went into the O2 shop in Bolton with a letter of complaint. I was put on to head office and they are now sending me a replacement.

The Sales of Goods Act route...no.

They said it is fit for its purpose as still makes and receives calls when they try it in their shop...almost said they didn't believe me that it didn't work most of the time

Am preparing a letter for head office like "Simon Olive" hopefully that will work... they forget i am a contract user and bring them £35 p/m

O2 shop staff suffer as much data loss as their network....

As I said its down to O2 to prove its fit for its purpose, not down to you to prove.

You simply state your case, quote sog act and state that whilst the problem may be localised to your home area and doesnt show up in their shop, the product is still not fit for purpose. Put it in writing, impose your conditions, number portability/convert to pay as you go free of charge etc, set a deadline, make it clear the problem wont go away and that after the deadline date you will not be paying any future bills, if they continue to charge you state you are prepared to dispute the claim/debt in court and prepare a full and frank defence to support non payment and send it special delivery.

Its then up to them to respond. Most corporates would shy away from putting something in writing. Either they must deny there is a problem or admit to it. It could open up a can of worms. What happens if you get an independant comms specialist to come to your home area to test your handset and network performance after they have denied there is a problem??

Whilst I was in the shop and the assistant manager was speaking to head office I actually heard her own up to the fact that there is a common problem with the Samsung E800 and they have sent a few away for repair with identical faults.
