The reasons you give are wrong, your understanding of networks is terrible.

And you say "up to 12%" and then go on to state you've got and seen 5mbps and 20mbps. That's more than 12%

I think it must be a design flaw with the S3 as my phone has always been faster on wireless on Three and also Vodafone so it's not network specific.

ALL NETWORKS VARY IN DIFFERENT LOCATIONS, come to my village my Mrs has an s3 and can get about 13mbps
