Because you are not. No site restricts you having access to the site. They restrict what and where you stream. As for the EU. Netflix is available in Ireland and some time this year will be available in France. By EU law we should be entitled to have access to these regions.

I'm pretty certain that isn't true which is why for example the football match can be sold to different countries within the EU at different rates (or not at all).

If you access netflix US you are obtaining access to a computer network that you are not permitted to. it is clearly an offence.

how is it not?

As per Section 6c of Netflix T & C, it is a breach of contract, not a criminal offence.

Quote:

it being a breech of their terms and conditions doesn't preclude it from being a criminal offence.

i'm not saying that it is likely that you would be prosecuted. but the computer misuse act specifically covers using a computer to gain unauthorized 'access to any program or data held in any computer, or to enable any such access to be secured.'

you are not authorised to access material available to US customers and it is a de facto crime.

i think logically we think well the only thing stopping me is that i don't live in the US, that can't be illegal. but the law makes no allowance. and as with all unauthorised access, but for a different set of circumstances you might be authorized. there is no special provision for geo blocking, your access is just not authorised.

Because you are not doing that. You have access to this site wherever you are. The streaming content is the only difference you will see on Netflix via each Country.

So why did a landlady of a pub win a case against Sky that gave her the right to show sport from another supplier from another Country in the EU?

i feel a little like i'm being trolled.

this is very simple.

so you are authorised to access some of the data held on their servers, but not all. and you employ a technique in order to circumvent that restriction. that you have access to some of the site is neither here nor there. i have access to some of http://www.whitehouse.gov/ . but if i attempt to access the parts that i am not authorised for that is an offence under the computer misuse act.

1- this is not computer misuse. nothing to do with computers. it was entirely in the realm of copyright and broadcasting law
2- the ruling was not that they were not allowed to charge different rates or make different content available in different parts of the EU.

Gee why do people accuse others of trolling just because of a disagreement? Any search will confirm it is no way illegal. You could even do it by accident on Netflix. My workplace uses a US proxy.If I am logged in nothing anywhere even tells me that it is the US version.
