Remember, almost everyone thought that Sony would loose the Betamax case against Universal 40 years ago, but it went the other way around. If universal had won, we may have never been allowed to record TV programmes, and this was a much clearer case of copyright protection that should have been leaning more towards Universal.
That said, if the Aereo court case did go against them, it won't shut down FilmOn. FilmOn's largest operation by far is their live UK channels, not their US ones. And this court case will only affect US live streams (the US does not hold global jurisdiction)
So, I presume by your question that you are referring to accessing free live US channels in SD (not that FilmOn was actually SD under their free service, but I digress).
There will still be USTVNow. I think their web access (sub-SD) is still free and they have permission to transmit their channels so won't be affected by this court case. But at the end of the day, you may have to pay to access live US channels. After-all, it is not exactly a standard service, and if you want something above the normal, it then becomes premium if you know what I mean.
Nimble TV also offer live US channels, but at a cost and unlike USTVNow which is designed for US servicemen abroad, Nimble TV expect you to have a US postal address. Their service may not be affected by this court case as they use different technology and may have permission from Dish Networks (not entirely sure on that, but they were after agreements when I first contacted them).”
1.well good luck thinking that AEREO will win after this was said
"Your technological model," Chief Justice John G. Roberts Jr. dourly told Aereo's lawyer, David C. Frederick, "i
s based solely on circumventing legal prohibitions that you don't want to comply with."
Justice Sonia Sotomayor did not seem persuaded. "It's not logical to me," she said, "that you can make these millions of copies and essentially sell them to the public."
Justice Ruth Bader Ginsburg said Aereo's business was built on taking content without paying for it. "
You are the only player so far that doesn't pay any royalties at any stage," she told Mr. Frederick.
Some justices said they found the service suspiciously complicated. "
Is there any reason you did it other than not to violate the copyright laws?" Justice Antonin Scalia asked Mr. Frederick.
