Hi

Sorry to have heard this happened, to all staff, losing jobs in tough times!

And others whom have placed deposits on the iPhone 6

I took our a contract in late July 2014 on a Nokia Lumia 520 £11.99 a Month x24

Part of the deal is, Cashback via redemption, over 5 occasions.

Now that P4U are in administration, puts them in a position where they no longer have to honour this Cashback? Which in a sense is them breaking their terms of Contract with me?

Am I able to cancel this Phone contract with EE due to the recent developments?

I received this Paperwork with the Handset.

There was something on the BBC site that stated that all existing contracts would be honoured - which includes discounted contracts similar to yours. Based on that, I assume you'll be fine. Of course, worth calling the helpline number that they've set up - not got it to hand at the mo though I'm afraid!

So if I send the required bills to the address in 2016 all will be honoured?

I would be very surprised if cashback is honoured, that's usually the first thing to go - you might be able to try and claim it as an unsecured creditor from the administrator if/when they start to sell stuff off. But I wouldn't expect much if anything back from that.

But as they decided to pull the plug a good 12 months previous, if I am not mistaken?

They are breaking their terms of contract with me surely?

I entered in to the contract on condition, I would receive regular Cashback over the period of the contract...

They would indeed be breaking their contract if they didn't honour it - that's why you would be able to claim from the administrator.

How do I go about claiming this £119.90 through Administrators? It would be better in one lump sum rather than 5 equal amounts.

The Phones 4 U customers services is supposed to still be running. If you contact them I'm sure they should be able to help even if it's to get details of the who the administrator is and contact / claiming details.

Can I get cash-back?

If you were supposed to get cash-back as part of your purchase, it depends on how the cash-back offer was set up - you may still receive it.

Check the terms and conditions to see whether the offer is backed by the manufacturer (ie they'll send the cash as long as you claim in the way specified), or whether the cash-back claim should be made to the retailer.

If the manufacturer is providing the cash-back, your claim shouldn't be affected.

If it's the retailer, you could still put in a claim and they would be in breach of contract if they didn't send the cash.

If you didn't get the cash, unfortunately you couldn't take court action against the retailer while it's in administration.

If at the end of the administration the retailer stopped trading, you'd need to lodge your claim for unpaid cash-back with the administrators.

You are likely to get only a proportion of this! Administrators normally end up paying x pence in the pound.

I tried calling the number they have listed on the Homepage earlier, but it is just a automated message saying it is closed...

That's the way it usually works, but I think this might be a bit different as they have been making profits, but the business is now no longer viable with only Virgin Mobile and their own network to sell for.

It is possible everybody will get their money, the employees, the tax man and the customers in this scenario, just a thought. They have done the right thing by pulling the plug now, rather than struggling on for months until they fail owing lots of money to people.
