They were both in the dance off. Alison may kick out Judy when in the DO again, but that's about it.

Thinking about it a bit more, this could just have been Len with his head judge hat on, telling the pros to do proper Foxtrot choreography and not copy pop videos. It's not necessarily Alison's fault that her routine had more Kate Bush than Foxtrot. It could be all bark and no bite though as he probably wouldn't sent a celeb home based just on the pro's choreography.

Should maybe have 5 judges - another female ? So that there is automatically a majority among the judges and Len can't have such potential extra power.

Actually it's good television if the vote goes to the final judge, extra tension, and it will happen quite often with just 4 judges. The maths pushes it that way. If there are five judges then they will decide it by 3-0 or 3-1 most of the time and Len would be redundant, which isn't a good thing for the head judge.
