How long are non-winners tied to Syco before they can move somewhere else?

If Syco isn't interested in signing an act, anyone know how long they have to wait before they can consider signing with someone else? I know they are tied in to Syco for the duration of the tour, but can they start working with other people during that time? Can Syco effectively stop them using the momentum they got from appearing on the show by stopping them working for months on end? Or can they still do publicity etc. with or without Syco's permission?

Thanks - that's genuinely frightening!

Looks like they can't sign with anyone else for three months, can't say anything negative about the show or Simon Cowell at all, can't speak to anyone in the media without permission, must promote the X Factor for free for a month after the show, and give full permission for any images of them or details of their life to be transmitted "anywhere in the Universe" for the rest of time.

And they can be over-dubbed in any language without permission too....

This bit is very interesting:

"they must use a lawyer “introduced by the company” when signing recording and management agreements with the show".

Pretty much none of the contestants have ever spoken out negatively about the show over the past 11 years...and it's obvious that certain ones would be dying to say stuff. This explains why they haven't!!

Parts of the contract may be invalid in some counties because of being subordinated to statutory commercial law or even from time to time labor law (not even mentioning European & Human Rights law etc.).
It often makes a difference whether the artist signs as person or through an incorporated business. I guess when signing for X Factor most of the candidates still sign as person, what may give them a better protection in court eventually (more chance that labor law can be invoked).
If Scowell wants to sue, he has to make his case in court.
Suing is always bad for publicity.

Maybe that explains why he hasn't done anything about Steve Brookstein's book? Or maybe Steve's contract only lasted for a set amount of years.

I suspect he feels Brookstein has been sufficiently discredited after years of being successfully portrayed as bitter and twisted. Who takes him seriously? He's been a figure of fun of years now. To treat it as an irrelevance avoids drawing attention to it or granting it credence (and therefore, I suppose, any journalist digging a little deeper).

Cowell's such an established and powerful media figure nowadays I doubt anyone wants to rock the boat for fear of blacklisting - his tentacles are spread wide and one only needs to look at the number of blind eyes turned to Saville's shenanigans to see how easily people ignore even the most abject of corruption when they fear their own livelihood could be compromised.

Does anybody know how it compares to other tv or record company contracts though?
It could be pretty standard in the business.

In the universe? So if we slagged off x factor and sent the text to Mars we would be in trouble.

So bottom line is by time you get round to possibly clinching a deal you're forgotton about and the next final 16 are already picked out and the fickle public have a new crush/favourite.

Sounds really great that.

Leona Lewis publicly blogged about how they threatened her with saying she "got dropped" if she was to leave them and now she's successfully signed to Island Records (one of the biggest based in the U.S)

Simon seemed fine with that....

So she managed to negotiate herself out of it somehow. But not until long after her career had pretty much stalled due to their indecisiveness. Presumably now Cowell has Ella he was finally bored of holding onto Leona so softened and let her go. Or she got some serious legal help, perhaps with the help of Island. Who knows?

Simon is basically doing everything with Ella that he can no longer do with Leona. He'll be bored of her in about six months.

It will certainly be interesting to see if her career follows a similar arc overall- i.e. one huge lead single into which all the money and thought went, then a series of diminishing returns until she's effectively silent for a long period of time, save for being wheeled out every now and again on Cowell's shows like some sort of trophy.

Excellent post.

I have had misgivings about the whole machine for several years now.

I wish more parents were aware of what their offspring are really watching when they allow them to engage with this show. It certainly has been an eye opener for me. I cringe when I watch so-called respectable TV presenters endorsing the whole nasty propaganda machine, whilst laughing and cheering for the next exploited person who has just won the show. Many with journalistic backgrounds or studied at higher level and they know how a lot of things work.

When contestants go out at the lives I find myself saying now, "Thank God they're free!"

When they are eventually released is another thing.

You have to ask yourself why such contracts?

This Regime needs to go.

I always think Simons smile is the smile of a shark. Talk about "Simon says". Jump and they say how high.
Plus what's his relationship with Sinitta about? Has she got something on him?
Plus I'm not surprised his engagement faltered. She looked unhappy to me towards the end.
Wonder what "her indoors" thinks about the whole set up they have.

Scowell is so obsessed with himself he is hardly going to have much love on offer for a loving relationship. Having women draped on his arms always gives the impression he at least is into them.
