Yes he is refusing to answer questions about it. How can telling the truth about it incriminate himself? It's all "a tragic accident" according the Crown Office and there is absolutely nothing criminal about the incident . Could they be wrong and he could say something that can be used in a private prosecution to convict him?

No references ever taken up for his council job, key documents being 'misfiled', immediate decision not to prosecute..

This miserable lying specimen's a darned sight more fortunate than the six people killed by the truck he was attempting to drive.

Clarke seems to have lost his memory of event from the past... seems he just eradicates them. or he chooses not to answer questions... even when asked if he had a daughter...the man is disgusting.

as Ive said from the start of this thread but was shouted down by it being only and accident.... its not wonder the families have left in disgust at this man who has no empathy or conscience about others,Im being polite about him compared to some scottish sites.

This is just heartbreaking. The families deserve to know exactly why their loved ones died in such appalling circumstances. I have to commend the families though for their strength.

Any solicitor worth their salt? No comment is always the way to go to all questions when under threat of prosecution.

As Evo said up above, the families have shot themselves in the foot. His legal team will advise him not to answer anything.

He has said from day one that he (very conveniently!) doesn't remember anything at all about what happened at the time of the accident, so I very much doubt whether the enquiry would have got very much out of him even if the question of a private prosecution wasn't being considered.

So this lowly bin man has a "network of very discreet and loyal 'friends'" in the council, police and crown office? I think even Jimmy Savile would have been hard pressed to pull all those strings at once.

I feel this too and said that after hearing about them walking out of court... doesnt Clarke realize that these people only want answers, they might even have softened towards him, I wouldnt but then thats me.. Could he still refuse to answer even when NOT under threat of a Private Prosecution.

Bit of a messy procedure, not on a par with the English system.

Hope so. It suggests that it is possible for him to incriminate himself which is totally at odds with the Crown Office view that nothing criminal happened.
