Brief description. Sold my daughter's iPhone on eBay recently. Despite using the useless Next Day Guaranteed service from Royal Mail I had no word that he'd received the phone. Now, 10 days later he says he's not happy as it doesn't work with his sim and wants to return.

Then amount of hassle this one man has caused surpasses all I have ever had in 12 years on eBay so I agreed he could return it. Now he says he's on holiday and will sort it later. So, the original question, I have the imei of the phone and my daughter is the original owner so will they tell her if the phone has been used recently or would I have to know what network it has been used on?

BIB, would who tell her if it has been used?

There is no way that anyone can find out if a sold iPhone has been used or not by a new owner other than:

a) If FindMyiPhone is still installed and the Apple ID and Password is the same your daughter used, which is 100% NOT likely you can track where it is using another iOS device.

b) If the iPhone was reported as lost/stolen then you could block it that way to prevent further use of it but I'm not sure you can unblock it again (might be wrong though).

I guess there is every chance that the man you sold it to is using it while he is on holiday with all intentions of sending it back to you when he returns, honestly I think you should either message him again and tell him to get a family member to return it by a set date or refuse to accept any return from him.

As above, you can't tell if the phone is being used.

Assuming that the guy has paid for the phone, and you haven't refunded him yet, then you still have the upper hand. Just wait it out and see what happens.

If the person has paid by PayPal tread carefully as they can just claim the money back easily from PayPal and you will have the money taken from your PayPal account and if you have no money in it they will put you in the negative and send you debt collection letters it has happened to me. It not fair but that's the way PayPal works 😔 they are more in favour of the buyer than the seller.

I second this, as the exact same thing happened to me on 2 occasions, one £200+ guitar sent recorded but PayPal still refunded the buyer the money. 1 custom made dvd which dispite stating delivery time of 1st class PayPal refunded money as they said they wanted it next day. Never saw the items or the money again, hence I sell very little on eBay now. You have very very few rights as a seller with PayPal and and increasing amount of users know this and the exact ways to exploit it to the max.

I always sell phones and stuff like that on Gumtree so people have to come to me in person and pay in cash. Far too many Paypal chargeback scams on eBay who always side with the buyer.

Unfortunately eBay doesn't work like that. At no point does the seller have the upper hand.

A buyer can get an item, use it/break it/decide they don't want it. And whack a not as described claim in. 99.9% of the time eBay will side with the buyer ignoring any evidence from the seller and will tell the buyer to return the item. Once the buyer inputs tracking details (he will be told to return it via trakable postage) eBay will refund. If the cash isn't in your PayPal account it will go into the red. They will chase you until you clear the debt.

You can't tell him to return it via a selected date or you don't accept a return. Because PayPal allow charge backs for 180 days. So unless it's after 180 days then they can simply file a claim through PayPal for not as described and get their cash back.

If you're lucky OP the buyer will return the item In the conduction it was sent and you'll be able to sell it again. But if the buyer has damaged it in any way don't expect eBay to do anything.

A quick read of the MSE eBay board will show how much of a scammers paradise eBay has become with buyers having to jump through hoops to accommodate buyers demands of they want to keep their eBay accounts.

Unfortunately with eBay buyer is king. They can pretty much do as they like and a seller can't even leave negative feedback for them.

I've only had two big problems selling on eBay, and I won both disputes. Yes, PayPal froze my account while it was being investigated, and this took a couple of weeks.

Thanks for the replies all. I know about eBay's worship of the buyer to the exclusion of a seller's rights. He hasn't gone through eBay with his complaint, just endless messages. Obviously eBay can view these to check my frustration but if they side with this idiot I will be most upset.

If he returns the phone in the same condition then fine, I will relist and hope to attract less of a numpty. Best thing would be for him to return without the insurance cover and for it to go missing, that would be interesting.

As far as I know when making a phone call the first check is for a valid, unblocked imei number, then of course a valid account. Hence my question about seeing if the phone had been used.

At least if eBay don't side with you and return his money, you can report the phone stolen to get the IMEI blocked so that he won't be able to use it on any UK or at least EU mobile network (it'll still work on wifi though, unless it's still tied to your daughter's iTunes account so you can block it there too)

I would go through eBay's resolution procedure and get them to settle it. Everything you write screams this idiot is taking you for a ride.

I am assuming you have tried to get to the bottom of why he is saying it doesn't work with his sim? Is the phone locked to a network etc etc. Or has he just decided that he wants to return it and that is that?

Just to get the full story; is the phone unlocked for all networks?

My daughter tried both EE and O2 sims in the phone, then returned it to factory setting to delete everything. I don't have nano sims to test iPhones. I'm going to wait for it's return and see what it's like before I go ahead with anything.
