Marc wasn't saying the case was cooked up between them. His point was just that she must have known -- before she went on the show -- how the show worked and that the show would pay what she was owed, rather than her friend having to pay. She denied that she knew that before she went on the show, swearing on her mother's grave.
He was trying to trip her up, but with the aim of getting her to admit she'd known that aspect of how the show worked. Perhaps he'd have gone on later to saying the whole case was cooked up between her and Michael, but that wasn't what he was saying then.
