I suppose you can say it ruined his future opportunities but the police had every right to haul him in for it as it was his house the incident happened.

Silly man. The police were doing their job, end of story.

It's not the police he should be suing (they were right to arrest him, along with anyone else who was there), it's the papers. The tabloids are a massive disgrace, as is proved time and time again with their behaviour. They already had it in for Barrymore before this happened so you could positively hear them rubbing their hands together. They pounced on him good and proper, because they could.

It has been suggested that Stuart Lubbock received the injuries they always go on about after he had died, as a way of trying to fit someone up for his death. There are people out there sick enough to do something like that.

Though the truth of what happened will probably be never known. Personally I don't think Barrymore knew what happened, i.e. he wasn't involved and didn't witness it.

What a bizarre comment.

The only way to know if you've done something wrong is to be convicted in a court of law, as you're innocent until proven guilty.

Therefore you're suggesting that someone should go on trial and be convicted before the Police can arrest them.

The only problem I had was that fathers comments on blaming Michael. Stuart was a full grown adult and if he took the drugs on his own accord you cant blame anyone else but himself. Its not like its a under age child. Adults are responsible for their own actions.”

The Police are entitled to arrest anyone who they suspect is guilty of a crime.
If they didn't have this right, they might as well not exist.

Deleted on second thoughts. Poor taste comment. Naughty me.

The death occurred in his home, in suspicious circumstances so I think the police were right to arrest him. He was released without charge so I don't see why he should get a payout.

I could never stand the bloke anyway and wasn't his career pretty much over anyway before this?”

"and what is a hot spot not?"

Hmmm.... a bit off... just.

The police can arrest anybody who they have reasonable grounds to suspect is involved in a crime, or where they have hard evidence to that effect.

I'm not too au fait on this case, but as I understand it, the only grounds for suspicion the police had about Barrymore was that the tragic event took place in the swimming pool at his house. That on its own is not enough grounds for arrest.

He could have been questioned informally and notified that enquiries were ongoing and he may be questioned further at a later date.

If the police are found to have been heavy handed in this case, or made an inappropriate arrest, and this had a deleterious effect on his career, then his action might just succeed.

Sounds a tad homophobic to me.

Your saying that gay sex and pool parties are disgusting?

Would you be saying that if you were surrounded by women at a pool party and could make out with any or all of them?

I hope he loses this action. I think he knows exactly what happened that night, whether it was an active role or just voyeur. I also think thats why he had a breakdown, because he knows what happened.

I also got the feeling at the time that the press were just going for the really sordid part of the story and not really doing anything for the victim because he was a man. If it had been a dead girl in the pool with those sort of sexual injuries, then I think there would have been a much bigger uproar.

It has to be on a no win no fee basis. Although who on earth is that desperate for business?

Maybe it's about time he learned, he's not powerful, not above the law, few people care and he's sad joke.

Spot on.

No one is interested in what the seedy, incredibly narcissistic git gets up to anymore.

I thought that legal aid had been cut for this sort of thing.

I guess that it's no win, no fee.

People are arrested on suspicion every day. Then it's for the courts to decide guilt or otherwise. That's how the process works.

Many thanks jackol for setting me straight, I have no idea where I picked up the theory that his career was on the skids, but happy to admit I got it completely wrong....

Actually there's another element

https://www.gov.uk/government/upload...ode-g-2012.pdf

Quote:
“2. Elements of Arrest under section 24 PACE
2.1 A lawful arrest requires two elements:
A person’s involvement or suspected involvement or attempted involvement
in the commission of a criminal offence;
AND
Reasonable grounds for believing that the person’s arrest is necessary.”

I guess there's a small possibility he could be arguing that necessity wasn't present, but I'd be surprised if it goes his way.
