That's true actually never thought about that if Max did that to Phil or any of the Mitchell's Phil would go on the warpath and it would affect all 3 families and it would explain the Max and Ben confrontations in tonight's episode.

The Ben theory would be good. Not sure when Kathy returns, or how long the suspect would be a suspect, but with her return, her son being accused of killing her granddaughter! quite a dramatic entrance!
