I must have missed something. How come Jay was arrested for the mugging, but Ben has been released? Did Phil tell Marsden that they were both involved, and if so , has Ben been charged with the mugging also?
I can only assume that having already been questioned in relation to the robbery at the off licence and the fact they now know he was on that bus with Lucy the night she died, they have enough evidence with his prints being on Lucy's belongings to charge him.
Not sure why Ben is not charged though because as you say he was with Jay the night they robbed the off licence. What hasn't been clarified is which robbery he is charged with, I assumed it was the off licence.

Ben was probably charged as well, but because it was just theft he would be let out on bail until a trial, Jay has to be charged for it as well and will also be let out on bail until a trial..
I'm not sure either the previous episode Marsden said they need to speak to Jay nothing about arresting him for robbery and Ben I presume has been bailed until charges are brought but what evidence do they have on Jay, Ben hasn't said anything about him being involved as far as we know and the guy who ID Ben only mentioned him and no mentioned of a second person DNA beeing found because Jane's would be over it as well!
