In Scotland he would certainly be open to charge of Threatening & Abusive behaviour. It's within what's more commonly known as "breach of the peace" laws. Not sure what the equivalent is in England & Wales.

Come on, it takes a lot for the police to lose patience with all the foul-mouthed drunks they have to deal with at weekends.
