It was as much an accident as Bobby killing Lucy , as far as we know neither one set out to actually kill/hurt their victims .

No , he's on trial because back then he lied to the police , then a witness showed up who contradicted his statements and Lucy's blood then sealed the deal . Abi is just one piece of the puzzle .
