Depends who made the first strike to be honest. Whoever went first will lose, the one who acted second acted in retaliation. It also depends on the severity of the retaliation - e.g if you shoot someone after they punch you, unlikely you an argue self defence as it's not proportionate (which it must be under Palmer).
